There is much hilarity in the responses:

So wrong. Lockdowns are overwhelmingly not harmful and effective. Cloth masks work well if all people wear them. You clearly don’t know how vaccines function. You want to get people sick and put them in a position to have to risk death all so you forward your campaign narrative.

What is it about having gone to a small teachers college in NEMO and a small Catholic law school that makes you think you know more than 99% of the world’s scientific community- epidemiologists, physicians, and virologists? Leadership means listening.

Want to know what causes harm to children? Having to practice active shooter drills and having to explain to my child why those exist. It’s a sad world when people worry about a thin piece of cloth to prevent spread, but not a gun brought into a school intended to cause harm.

This is an absolute lie. We are struggling because we cannot keep up with onslaught of COVID cases – mostly from unvaccinated people – many of whom chose to believe the disinformation put out by you your ilk.

AN ACT

To amend chapter 27, RSMo, by adding thereto one new section relating to attorney’s fees for certain civil actions instituted by the attorney general.
Be it enacted by the General Assembly of the state of Missouri, as follows:

Section A. Chapter 27, RSMo, is amended by adding thereto one new section, to be known as section 27.140, to read as follows:
27.140. 1. In a civil action brought by the attorney general pursuant to section 27.060 against a political subdivision, including school districts, the court shall award attorney’s fees, court costs, and all other expenses incurred by the political subdivision or school district in defense of any such action brought if the action is terminated in favor of the political subdivision or school district.
2. Any award given pursuant to this section shall be paid by funds appropriated to the attorney general by the general assembly on an annual basis for the expenses relating to the operation, personnel costs, and equipment of the attorney general’s office, and shall not be paid from any other designated statutory or administrative fund.

We’re back to seeing all-time high 7-day averages statewide, reflecting still increasing rates Outstate and plateaued rates in STL/KC.

I had hoped that any gains Outstate would be offset by declines in the two major metros, but that hasn’t panned out. STL’s decline has stopped and rates have climbed slightly, and KC as yet to fall away from its peak.

Over the past 3 days, one striking trend has been all-time high rates in counties that are higher than any we have seen. As I wrote in last week’s newsletter, McDonald County in SWMO had set the highest 7-day average way back in the spring of 2020.

Now, McDonald’s record-setting rate no longer places it in the top 10. Instead, Boone, Buchanan, Christian, Greene, Nodaway, Pettis, and Vernon counties have all surpassed McDonald’s prior high.

Nodaway County is leading the pack right now with Buchanan not far behind – both are nearing 400 new cases per day per 100,000 residents on average – just a staggering level of new cases relative to anything we have seen before.

Just to the south, in the counties that lie just outside of the Kansas City Metro, we have a significant bloc of counties now with rates over 300 per 100k – Henry, Pettis, Saline, St. Clair, and Vernon, with Pettis and Vernon among the top 10 in MO right now.

Mid-MO’s Boone, Callaway, and Cole counties all are over 300 new cases per 100k. I’ve been particularly focused on Boone County lately given the lack of precautions in place at the University of Missouri as classes began last week.

Further south around Springfield, Greene County’s rate is at the same level as Buchanan County – over 370 new cases per 100k. Christian County is also in the top ten.

Hospitalizations around MO have increased substantially. As of mid-January, hospitals in Mid-MO, Kansas City, and St. Louis were seeing more COVID patients than at any point prior during the pandemic.

Hi Attorney General Schmitt,

We are in the Rockwood School District in Saint Louis County.

I walked my kindergarten daughter into her school today without a mask and your letter in hand. Her principal did initially let her go to class without a mask, but said that she would need to reach out to her district supervisor and then give me a call later. After she spoke with her supervisor she let me know I had three options. I could come pick her up, I could send her back to class with a mask, or I could send her to the library to learn for the rest of the day segregating her from the rest of the class.

My daughter hates masks so much, but still wanted to stay in school so she chose to go to the library to learn for the day. I have an email into the district asking them how they feel they are above the law and how legally they have the right to segregate my healthy child away from her classmates because she refuses to put a mask on her face that is illegal and unconstitutional for them to enforce in the first place.

Our interim superintendent Dr. Ricker responded to your letter yesterday basically by stating that his attorneys assure him that he does not need to follow the law. Another thing that is unique about Rockwood is that our board has never voted on the issue of a mask mandate. Our superintendent has been the only individual making the calls for our entire district.

I appreciate all you are doing to help put the power to parent our kids back into our hands. I look forward to what type of enforcement action you will take against our district and specifically Tim ricker who is the worst of them all.

Interestingly, even with the significant number of complaints about masking requirements in private and parochial schools submitted to the illegalmandates@ago.mo.gov email address Eric Schmitt (r) doesn’t appear to have filed lawsuits against them. Why would that be the case?

Attorney General Eric Schmitt (r) didn’t need to open up his state funded “snitch on your local schools” email address. His office could have simply visited school district web sites and/or directly requested information. Aside from involving individuals in his U.S. Senate primary campaign publicity stunt, his actions damage the relationships between the community and their local school teachers, school administrators, and elected community school boards.

They have a plan.

2. 9 days back in school and my middle school had over 10% positive Covid cases without masks. The close contacts outnumbered the student body.

It is not ineffective. It’s imperfect, yes, but masking reduces the spread of disease significantly (and not just COVID, either). You are lying to people, and you’re not helping anyone but yourself.

Sir, my kids’ school district had 35 cases as the highest rate with a mask mandate in place. Two after it was allowed to expire, it had gone to over 100. This past week saw 270 cases. We are now shutting down schools because everyone is getting sick. Please stop grandstanding.

Missouri Attorney General Statement on School Districts Continuing to Enforce Mask Mandates, Quarantine Orders

JEFFERSON CITY, Mo. – Missouri Attorney General Eric Schmitt today released the following statement addressing school districts that continue to illegally enforce mask mandates and quarantine orders despite the recent Cole County ruling:

“School districts have never been given the authority by the legislature to enact public health orders like mask mandates or quarantine orders – the recent Cole County judgment just further affirms that fact. The decision to mask children in school should rest solely with parents and families. Last month, I informed a number of school districts that their decision to continue to enforce mask mandates is illegal and must be stopped immediately. Some school districts dropped their mask mandates and quarantine orders, but others continue to defy the law, despite the fact that COVID-19 poses very little risk to children. My Office is currently finalizing lawsuits against all non-compliant districts to end the forced masking of schoolchildren, which will be filed later this week. It’s far past time that the power to make health decisions concerning children be pried from the hands of bureaucrats and put back into the hands of parents and families, and I will take school district after school district to court to achieve that goal.”

District to close for the remainder of this week
Last week, we shared with you that the COVID-19 surge in Springfield is having a negative impact on our staffing levels at schools. Today, we have continued to see the number of both staff and student absences increase dramatically. Over the last week alone, SPS has documented 863 cases of COVID-19, impacting 661 students and 202 staff. In addition, this has led to challenges in recruiting available substitutes.

At this time, the best option to address staffing shortages and help limit further spread of COVID-19 is to temporarily close our schools and district offices beginning tomorrow – Wednesday, Jan. 19. We hope that by Monday, Jan. 24, we will be able to return to our normal operations; however, we will continue to monitor conditions and keep you updated if there is a need to extend our temporary closure. In the meantime, all in-person and live virtual instruction are canceled for the remainder of this week.

Please note the following:

While district facilities are closed this week, all SPS sites will undergo a thorough cleaning.
The district’s centralized testing location will remain open, but COVID-19 testing will be limited to symptomatic SPS staff until further notice. This will allow SPS to accommodate the demand for appointments with the available inventory of test kits. For other testing opportunities, visit this website.
Grab-and-go meals will be available for students throughout the temporary closure and sign-up is required. Five days of meals will be available for pick-up on Wednesday, Jan. 19, from 4 to 5 p.m. at select sites. To sign up for meals and learn more about pick up, use this form. Note: If you are currently enrolled in virtual learning and already receive grab-and-go meals, additional sign up is not required.
If the current staffing shortages are not improved by Monday, the district will provide an update, which may include an extension of the temporary closure or a transition to virtual learning.
We understand that this change creates a disruption for families and have taken every measure available to avoid this step; however, we are currently unable to continue providing appropriate staffing in our schools. In consultation with the Springfield-Greene County Health Department, we determined that this was the best approach for protecting the health and well-being of all those we serve.

SPS encourages you to practice social distancing by limiting public interactions, wear a mask while in public settings, monitor symptoms daily, schedule a test if you’re symptomatic, and if you have not already done so, get a COVID-19 vaccine or booster shot.

We appreciate your cooperation and understanding as we continue adapting to the difficult circumstances created by the ongoing pandemic.
