This afternoon we received a response from the office of Missouri Attorney General Eric Schmitt (r) complying with our December 9th RSMo § 610 “Missouri Sunshine Law” request for the contents of the illegalmandates@ago.mo.gov email address set up by the Attorney General to solicit complaints about mask wearing in Missouri public schools.

That’s over 8,000 pages in four files. It’ll take a while to go through it all.

A start:

Hi I’m writing you regards to the court order to stop all missouri schools, mask and quarantine mandate. My local school district slater mo public schools, have told me they don’t have to abide by this. How is this the case? They have stated they will consider looking at the court order at the next school board meeting in January. But until then it’s ok for them to tell my children they have to wear their masks even though my children are vaccinated? But yet the teachers that are vaccinated are not required to wear masks. How is this okay? This is double jeopardy. This is taking away my child’s rights. I am their parent, nt the school. I know what’s right for my child not the school. It’s some straight up bs at this school. But yet the next town over immediately put it into effect to do away with all quarantine and mask mandates…your help is greatly appreciated and needed.

Mr. Schmitt the Elsberry school has decided to not follow the ruling, citing they have the authority to do whatever they deem necessary. They decided last night to continue to mask and quarantine what they dem close contact students. They changed the term quarantine to exclude , and feel that you and the court ruling do not apply to them. We would like for the superintendent [….] to receive a letter from your office. Thank you sir for all that you do for the people of our state.

The actions of your administration are beyond deplorable. You are taking away the only few tools we have at keeping our children safe in school, and you are allowing the virus to propogate and overrun hospitals with critically ill and dying humans. Subject: A concerned MO parent

Dear Attorney General Schmitt,

It is very concerning to me that you are pursuing action against school districts and health departments for enforcing masking and quarantine guidelines for our children in Missouri. I ama parent and have 2 children in school in Missouri that were just recently eleigible to receive the vaccine. We would like to visit our immunocompromised family safely for the holidays. Which is why I chose to vaccinate my healthy children, so they are less likely to silently spread a disease that is killing our elderly, immunocompromised, and many other healthy adults and childrem.

I do not support your continued efforts to pursue legal action against schools and health departments at the expense of taxpayers. It appears to me you are doing this at the best interest of your political gain and not for the good will of the people and children of Missouri.

In our next election all eligible voters in my family will be supporting someone that is in favor of keeping our communities safe and children in school safely. The individual rights of an American citizen to not wear a mask or choose not to receive the vaccine during high community spread of a virus that has killed more than 700,000 fellow Americans stops when they directly impact community safety.

I pary for the continued safety of our community and the knowledgeable public health departments and their guidelines to keep us all safe.

As a parent and a Missouri educator I am outraged at the way you are using taxpayer dollars to bully Missouri schools. As if we haven’t been through enough in the last year, we have a state government leader trying to divide our communities and turn our parents against us. Why, as an elected official, sworn to SERVE the people of Missouri would you choose to put us in harms way? The science is clear. Masks help stop the spread of COVID. The numbers in Kansas City and St. Louis County as compared to the rest of the state where mask mandates were in pace prove their effectiveness. We teach some of our most vulnerable population, children. Our teachers havehave put their lives in harms way to do their jobs the last year and a half. The least you can do is support us or get out of our way. Your leadership is the type of dividive rhetoric that has torn this country apart for the last five years.

Good morning, my son goes to Lafayette High School and their Rockwood School District still requires for all students to waer masks – Lafayette, Eureka, Marquette, etc. I hate to see my son waering a mask to school and this needs to be stopped ASAP. Hopefully there’s something you can do. Thank you!

FYI – East Central College, Union, MO, has a full mask mandate for all students and staff. Along with the normal student population, there are some high school students that attend classes on campus as part of the dual credit/enrollemt programs.

Here is what’s happening in the St. Joseph MO school district. We have mask mandates currently in place in 4 of our schools, with the threat of implementing it in as many as needed if they can ‘manipulate’ the numbers. AND, they are ‘encouraging’ the use of ‘false-positive tests’ to allow you to remain in school……These mandates are crimes against humanity, and we are SO VERY THANKFUL that you are fighting for us! Dear Mr. Attorney General,

As a teacher I can not understand why you are pusjing for getting rid of masks during a pandemic. Do you realize that we have a teacher shortage ? Do you realize that we can not get substitute teachers right Now when teachers get ill ? How do you expect us to teach these children when we are ill ?

I would also loke to add that there has been 2 teachers in the past 3 weeks who were vaccinated who have gotten covid. One of which is currently in the hospital intubated bcause they are so sick. So tell that taecher’s family that we should have all 2000 students no longer wear masks in my building when we are getting sick because they just don’t wear them properly.

Please thik of the GREATER good of your constituents and not the base that you hope will elect you next year.

Hello
I’m writing to complain of my local health department, specifically [….] mandating my child quarantine as she is a close contact. I did discuss the letter that was sent to health departments this Tuesday, however; she stated that I was misreading it and that a student still has to quarantine at home if it was a close contact in the household. ‘She will and must enforce this quarantine.’ I have not had any conversations with the school about it and have continued to send my child to school due to the recent order. I am very frustrated with the authority she believes she has.

As a parent of 3 small children I find the ruling and the actions of the AG this month to be extremely disturbing. I am literally shaking with fury as I read the news. The most fundamental purpose of society is the protection of public health, without which basic liberty is impossible, ever since the first villagers agreed to not urinate in the water supply. The irony that an email submitted to the Missouri Attorney General’s Office with a boilerplate message tag is subject to public disclosure as a public record under RSMo § 610 probably escapes the author.

Our children attend CPS in Columbia MO. We would like to see masks mandates within the school system lifted as well as quarantining. It has been brought to our attention that the school board is ‘digging in their heels’ as one staff member replied to me.

The board is putting CPS staff members as well as the school district in a bad position.
All that appears to be affected within the district we see is state funding, student & staff attendance, health (physical & mental) concerns as well as constitutional rights violated.

We finally received a response this afternoon from the office of Missouri Attorney General Eric Schmitt (r) complying with our December 9th RSMo § 610 “Missouri Sunshine Law” request for the contents of the illegalmandates@ago.mo.gov email address set up by the Attorney General to solicit complaints about mask wearing in Missouri public schools.

That’s over 8,000 pages in four files.

It’ll take a while to go through it all.

In a quick reading through the start of the first file of email responses sent to illegalmandates@ago.mo.gov there is a very interesting mix.

Self-identified parents and school district employees seem to delight in turning in their schools and school districts. We never get out of junior high school.

There were several emails with a request to not reveal their identity because they feared some form of retaliation and/or the discontinuation of their at-will employment. Seriously. RSMo § 610 doesn’t allow for that. Guess what? All of that information is contained in the document. Pro tip: public business is public, with limited exceptions.

There were emails chastising Eric Schmitt (r) for wasting public money on this campaign publicity stunt.

There were several response from adult/porn sites confirming the sign-up of the illegalmandates@ago.mo.gov email address. Apparently some residents of Missouri have knowledge of these sorts of things.

There were parents complaining about mandatory masks and other COVID-19 protocols at their child’s parochial school. Think about that for just a second.

The current statutes, which were effective on August 28, 2021, provide immunity from liability for exposure of an individual to COVID-19:

RSMo § 537.1005. COVID-19 exposure, immunity from liability, when — assumption of risk, signage — no third-party liability, exceptions. — 1. Notwithstanding any other provision of law to the contrary, and except as otherwise provided in this section, no individual or entity engaged in businesses, services, activities, or accommodations shall be liable in any COVID-19 exposure action unless the plaintiff can prove by clear and convincing evidence [….]

RSMo § 537.1010. Health care providers, immunity from liability, exceptions. — 1. Notwithstanding any other provision of law to the contrary, and except as provided in subsection 2 of this section, no health care provider shall be liable in a COVID-19 medical liability action unless the plaintiff can prove [….]

RSMo § 537.1015. Covered products, no COVID-19 products liability, when — evidence required for liability — inapplicability, when. — 1. Notwithstanding any other provision of law to the contrary, and except as otherwise provided in this section, no individual or entity who designs, manufactures, imports, distributes, labels, packages, leases, sells, or donates a covered product shall be liable in a COVID-19 products liability action if the individual or entity [….]

HB 2201 [pdf] adds sections which would reinstate liability for each of the three existing statutes:

[….] The provisions of this section shall not apply to any individual or entity or religious organization that has a COVID-19 mandate. A mandate may include, but is not limited to, requiring a person to:
(1) Be vaccinated;
(2) Wear a facial covering or mask; or
(3) Socially distance himself or herself from others. [….]

[….] The provisions of this section shall not apply to a health care provider with a COVID-19 mandate. A mandate may include, but is not limited to, requiring a person to:
(1) Be vaccinated;
(2) Wear a facial covering or mask; or
(3) Socially distance himself or herself from others. [….]

[….] The provisions of this section shall not apply to an individual or entity that has a COVID-19 mandate. A mandate may include, but is not limited to, requiring a person to:
(1) Be vaccinated;
(2) Wear a facial covering or mask; or

That is, COVID-19 liability protections which were extended to various entities in the last legislative session would be removed if these entities require vaccines, masks, or social distancing.

GOVERNOR PARSON ANNOUNCES COVID-19 RELATED STATE OF EMERGENCY TO EXPIRE ON DECEMBER 31

DECEMBER 30, 2021
JEFFERSON CITY — Today, Governor Mike Parson announced that Missouri’s COVID-19 related State of Emergency will expire and not be renewed on December 31, 2021. Governor Parson first issued an Executive Order (EO) declaring a State of Emergency existed due to COVID-19 on March 13, 2020.

“Thanks to the effectiveness of the vaccine, widespread efforts to mitigate the virus, and our committed health care professionals, past needs to continue the state of emergency are no longer present,” Governor Parson said. “Over the last 22 months, we have coordinated with local, state, and private partners to mitigate COVID-19 and work towards returning to normalcy. We all now know how to best fight and prevent serious illness from this virus. The State stands ready to provide assistance and response, but there is no longer a need for a state of emergency.”

Governor Parson extended the COVID-19 related State of Emergency five times before issuing a final targeted executive order for health care needs in August 2021. Currently, only three of Missouri’s border states and 20 other states in the nation have state of emergencies related to COVID-19 in place.

At one time, nearly 600 statutory and regulatory waivers were approved across Missouri state government. Since that peak, waivers have reduced by nearly 80 percent. All remaining COVID-19 related waivers authorized under EO 21-09 will terminate on December 31, 2021.

Agencies, boards, commissions, and departments are able to pursue rulemaking if permanent changes to regulations are needed after December 31 to improve long-term outcomes for Missourians, health care facilitates, and businesses. The General Assembly can also make any needed policy changes when they return for the 2022 legislative session on January 5.

The state has communicated to its health care partners that there will be flexibility during a transitional period to fully resume pre-pandemic operations.

With the expiration of EO 21-09, the Missouri National Guard will no longer be activated for COVID-19 related missions.

“In Missouri, we never had mandates or forced lockdowns,” Governor Parson said. “The main focus of our state of emergency was to provide regulatory flexibility to support and assist Missourians, health care facilities, and businesses and coordinate a COVID-19 response that saved lives and livelihoods. We encourage all Missourians to consider COVID-19 vaccination and to stay diligent, but we can work together to fight COVID-19 while living our normal lives. It is time to take this final step and move forward as a state.”

The best method to prevent serious illness from COVID-19 is vaccination, and more and more Missourians continue choosing to get primary and booster vaccinations. In the month of December alone, more than 565,000 doses of vaccine were administered and 42 percent were part of a primary vaccine series.

Nearly 94 percent of Missourians 65 and older, the most vulnerable, have received at least one dose. More than 73 percent of Missourians 18 and older and over 62 percent of all Missourians have chosen to initiate vaccination.

From the Missouri Department of Health & Senior Services (DHSS):

53.7%. And only 1,078,450 booster doses administered in Missouri.

What could possibly go wrong?
