Elad Gross For Missouri
[….]
I sometimes sue the government on behalf of hurt people. The day before Thanksgiving, my government decided to sue me and start a negative media campaign in an Eric-Greitens-esque attempt to discredit my work.
I believe that the government should be accountable to the people it represents. A lot of folks agree, and that’s why Republicans and Democrats passed the Missouri Sunshine Law almost 50 years ago, so we could see what our government is doing with our money and in our name. But now, decades later, we have far too many government officials who think you and I shouldn’t see anything at all.
I represent a man who was temporarily detained in a St. Louis jail. Because the cell locks admittedly don’t work and the jail is unsafe, he was assaulted and severely injured. As part of our investigation, I asked for public records from St. Louis City. Over the course of a year, the City violated the Sunshine Law multiple times and delayed producing public records. I learned that attorneys, reporters, researchers, and other members of the public had similar issues with the City. I offered to help the City comply with the Sunshine Law on multiple occasions, and each time I was ignored.
As a last resort, I filed a Sunshine Law lawsuit against the City and several officials. Because of the number of violations involved, the lawsuit was very long and took considerable time to write. I again offered to resolve the dispute, and again the City ignored that offer.
Instead, the City and several of its officials decided to file an illegal lawsuit against me for daring to hold them accountable. They have asked for maximum monetary damages, including an award of punitive damages, which is not allowed in Missouri without special permission of the judge, permission they never asked for. They claim that once the City violates the Sunshine Law on a request, it can violate it as many times as it would like to without additional liability, a novel argument that I’m sure other lawbreakers would love to use in their cases too. Ironically, the name of the claim the City is using to try to shut me up and deter others from seeking transparency is called “abuse of process.”
The City spends a lot of its lawsuit disparaging me, saying that because I ran for Attorney General more than two years ago I should not be believed. I guess the City doesn’t want people running for office either, especially for an office that is supposed to police Sunshine Law violations. If only it did.
These City officials then shared portions of their work with the media in some weird attempt to discredit me. In their comments to the media, the government officials criticized me for… talking to the media. About folks – including reporters – being prevented from seeing public records. About people being assaulted in their jails! These City officials left out the fact that reporters approached me about the issues they were having, or that we have freedom of speech in this country.
Eric Greitens used to attack me for being a “Democratic operative” when I sued him for hiding records, well before I was a candidate for office. Josh Hawley, Eric Schmitt, and Mike Parson took their turns too. They all lost.
It’s a very sad time in the Show-Me State when some government officials act like they own their offices, like the people don’t matter. It’s a scary time when some officials are willing to use their authority and taxpayer money to silence citizens. In some states, these kinds of strategic lawsuits against public participation filed by the City are strictly prohibited. They should be in Missouri too.
If you’ve had issues with the St. Louis City public records portal online and are willing to tell the court about it, please feel free to reach out. Sounds like we’ll be in court soon
“…The AGO’s indefinite delay here – which terminated only by compulsion of the discovery process – crossed the line. This conclusion is also butressed by the fact that the AGO provided no further communication to DSCC concerning this Sunshine Law Request after May 1, 2018; had DSCC not filed suit, the AGO would not have produced the responsive records [….] The AGO’s wrongful denial of DSCC’s request violated the Sunshine Law….” – November 14, 2022 – Judge Jon Beetem – Cole County Circuit Court, 19th Judicial Circuit
Missouri Democratic Party Executive Director, Lauren Gepford, released the following statement:
“’t has become abundantly clear that Josh Hawley used his taxpayer-paid office as Attorney General to climb the ladder to the U.S. Senate, and apparently was willing to disregard the laws he swore to uphold in doing so. When the very person charged with enforcing our Sunshine Law can’t be trusted to follow it, Missourians’ trust in their government is undermined. Senator Hawley is no different from those career politicians he blasts on the campaign trail.’

Eric Schmidt (r) has initiated another “report your local school” campaign stunt. We’ll wait for a week or so to submit a “Missouri Sunshine Law” (RSMo § 610) request for the submissions.
The Students First Initiative aims to ensure a quality education for Missouri’s children by uncovering and eliminating curriculum and policies and practices that prioritize politics in the classroom instead of student education and success. The Attorney General’s Office urges parents to submit information about objectionable curriculum like Critical Race Theory, teacher training materials, school initiatives and speakers, administrative overreach, and other issues and practices that don’t prioritize student education and success in their children’s schools.
The Attorney General’s Office is dedicated to fighting on behalf of parents and increasing transparency in schools across Missouri. Upon receiving a submitted form, a representative from the Attorney General’s Office may contact you for further information or clarification. Submissions may be the subject of requests under the Missouri Sunshine Law, and may be subject to disclosure. Subject: Protect my children!
Hello,
I am yet another concerned parent within the Rockwood School District. We became part of the Rockwood family 1.5 years ago. We were formally with Parkway, (who have even deeper issues than I am here to get into.) I have never had a negative thing to say about Rockwood. The exceeded my expectations and my children couldn’t be happier in a tremendous staff-filled school. With that being said, It’s hard to believe I am going to this magnitude and writing you this letter.
I read on a local social media page that the children at Eureka Elementary, who decided to not wear their masks today we’ve outted from their fellow classmates, and normal learning environment to be singled out like animals we enjoy looking at through glass at the zoo.
I come to you with this message to ask for your continuous help. I worry if this continuous battle between Rockwood School District and the community will be detrimental, to not only my children’s education, but their friendships, their views on trusted adults at the school, and the future generation we are shaping into. School is the only place I cannot protect my children and their rights.
I thank you for your time and all of your help.
Hang in there,
[….]
“…We were formally with Parkway, (who have even deeper issues than I am here to get into.)…”
Really? Do tell.
“…I have never had a negative thing to say about Rockwood…”
Wait for it.
“…staff-filled school…”
WTF?
“…It’s hard to believe I am going to this magnitude…”
Apparent, absolute, Richter, or pomposity?
“…I read on a local social media page…”
Ah, the font of all truth and knowledge.
They’re kids in elementary school, they don’t just spontaneously decide to not wear their masks. What kind of parent does it take to send their elementary school age kid in to confront their teachers in this manner?
“…I come to you with this message to ask for your continuous help…”
He’s the Attorney General, not the second incarnation of Eric Greitens (r).
“…I worry if this continuous battle between…”
Too late. You should have thought of that before you started it.

Subject: Mask-mandates in schools
[….]
Good evening. As a voter, school teacher, and a parent with a child in 4th grade, I think that we should have a mandatory mask mandate for our schools. It is a crime to choose otherwise. Our students as well as the staff need to be protected. It would be a travesty as well as a tragedy. Please reconsider. [….]
[….]
Subject: We stand behind you!
Just kidding. You’re a power hungry fascist. LOL.
No, actually, you are. And that’s sad for you, and scary for me. You don’t represent me, my needs or my priorities. My taxes pay your salary, and that makes me naseous.
Your deperate, unfounded, anachronistic lust for control (guidance) is rationalized by hypocritical religious pablum. You know that, right? In your heart, you do, right. You’re not so dumb that you don’t right?
You’re building a house of cards, Eric, and it will eventually crush you.

Subject: Illegal? Hell, no!
Are you opposed to public health measures because you, in accord with your fellow travelers in the GQC, are in favor of death? In your case, that seems especially focussed on teachers and children.
Opposition to public health is not a platform. I have yet to hear you advance any positive agenda whatsoever. Nothing to offer the people of this state to improve their lives, health, or happiness. You offer nothing but death.
You need to resign and disappear. We could hardly hate you more.

Please help our children.

This is so sad.

Subject: Cease & Desist Denial – RSD
To whom it may concern,
Additional emails need to be requested from Rockwood School District, specifically within the Uthoff Valley Elementary. I cannot provide a direct copy for fear of being made known through such an act. Email traffic from today within Uthoff valley will show acknowledgement of the cease and desist letter, but still a blatant disregard for it. Kids were still told to mask.

Just the traffic?

Subject: Parkway mask mandates
As a Parkway employee who is occasionally responsible for filling in for bus drivers, we are still required to wear masks, the students are required to wear masks, and we are required to give out masks to any students who forgot them. If you require proof of that you can see it plain as day on the bus security feeds. As I don’t want my job put at risk, I’d appreciate being left anonymous.

If you send your name and email address to the Attorney General it’s part of the public record. In fact, this email is published here because of a Missouri Sunshine Law request addressed to the Office of the Attorney General. They complied to the request because it was their only possible response. The Attorney General’s Office did not redact your name or email address. We did. You can thank us later.

Subject: Attorney general investigation
Hello. I live in Missouri. Our attorney general is blatantly lying to people about mask mandates that have been legally ordered by our ELECTED shool board. He is trying to get people to take pictures of my son and others at his middle school wearing masks. I hear he wants pictures of elementary students, also. I think that is very creepy/suspicious and that someone should investigate this. Is that something you guys can do? Please let me know.

The submitted emails contain a significant amount of spam, some monkey wrenching in the form of the email address being used to subscribe to services of all types (including adult sites) and thus generating an automated ‘confirm your subscription’ email.
A significant number of the ‘tattle on our school district’ emails contain pages/web pages of attachments and email chains presented as ‘proof’ that run for pages and pages.
There are very view containing photos of school children as offered ‘proof’ of masking. Apparently even that was too much for the handwringing right wingnut crowd.
There are a number of sarcastic replies with mocking photos attached (of various types – ranging from inocuous [and funny] to more adult [extended middle finger]).
There are emails submitted taking issue with the Attorney General and his campaign publicity stunt.

Subject: your efforts re: COVID-19
Dear AG Schmitt,
I am the great-grandmother of five children currently attending Missouri schools. Thet are doing OK, so far, but your attempts to make mask-wearing optional in our schools worry me. Two of them have been diagnosed with asthma, which according to reliable sources makes them more susceptible to the Covid virus. One of them lives with a parent who has sever asthma. All of these children could contract the virus from other, unmasked children in their schools. Our public schools are tasked with providing a safe environment for education. If this cannot be done in the school buildings, they will have to go back to online distance learning, and we are already seeing signs that many, if not most, children lost ground last year, in spite of the valiant attempts of teachers to revise and manage this new learning medium. A safe, in-school environment is the necessary basis for children to learn well.
Last week we learned that state-rquested review of the data showed that mask mandates do indeed reduce incidence of infection and hospitalization. The Governor may choose to ignore this study, but you, in your position of responsibility, may not ethically do so.
As infection and hospitalization rates are rising with the onset of winter and the growing prevalence of the delta variant and potentially also the omicron variant, it is obvious that the cause of public health requires strong measures to protect the well-being of the whole population. We know from history that such strong measures (as in the 1919 influenza, the 1950’s poliomyelitis, etc.) can bring a pandemic to an earlier end. While many people may be inconvenienced and discommoded by such measures, when the pandemic is ended the people are grateful.
We have had too many deaths, and too many people disabled by ‘long Covid.’ We have had too many children lose ground in their education by the disruptions already resorted to. It is time to move on to a more practical and ethical approach. Inviting stressed parents to tattle to the AG’s office is not the way to go.
Sincerely,
[….]

My name is [….] I live in [….] I am sending this email because these schools think they know more than I do about my children, well my great grand children.
I have had these children most of their life..one evr since birth. My complaint is involving the Washington School which is District 200 and the other one is with the Heasstart school through Missouri Valley community Action Agency. of Sedalia. they just started a mask mandate on Dec. 6th 2021. Enough is enough the headstart are putting the mask on as young as 2 years old…no these kids dont need this they go through enough just getting prepared for the classes.
Please help get these muzzles off our kids.
Oh yes just so you know the kids are being suspended and or sent home for standing up and showing the schools a copy of your letter…[….]stated you are not his boss and you will not tell him how to run his schools.
thank you for hearing me out…I just pray you will help these kids…

I’m sure you’re receiving tons of these. This was sent out in a text notification from school.
Yesterday, my daughter was sent home after spending 2 secs in the nurses office for “COVID” symptoms and was required to have a Covid test before returning to school even though ear ache is not a symptom of COVID. Her stuffy nose and headache might have but it turned out she didn’t have COVID or strep, and her symptoms were easily corrected with allergy medication immediately after coming home. I spent 2 hours waiting on the test to come back to be able to send my duaghter back to school. That same night, we got notification via texts that a student tested positive for Covid. I attempted to contact the principal to determine if my child was the student referenced in the text.
I’m suspicious as to whether or not they are reporting accurately and since your office has started forcing them to look at their COVID protocols, I have received more and more texts stating students are testing positive. Since Dec 3, supposedly 8 students tested positive. Before Dec 3, the last notification of positive was November 19th.
[….]
You’d think they’d be more happy that their daughter tested negative.

Gee, were there no kids in school for part of the holiday period?

Subject: Concert with masks required for students
Hello,
This is the third email I’ve sent to you today (the last two were forwarded emails from [….] from Waynesville school district. My eldest daughter had a Christmas concert tonight and masks were required to be worn by the students although, the choir teacher(s) did not wear one. After the concert, my daughter was out of breath and her face was bright red. The choir does not normally practice with masks in school so my daughter was completely confused when she was told to wear one for the concert.
I currently have three kiddos in Waynesville schools, 8th, 7th and 5th grade. The two that are in middle school do not say anything about the masks because they fear reprimand. They FEAR standing up for themselves because they don’t want to get into any trouble. Mainly because we have taught them to obey the rules.
I’m going to attempt to attach a video and some photos. Please contact me if they do not go through. The video is just over 5 minutes long and my daughter is the second to the last student to go on stage. There are three photos, two of one teacher with different students and one of the other choir teacher at the piano who is not wearing a mask.
[….]
Recent scientific literature shows that singing and group singing is one of the most efficient means of spreading COVID. Incidently, piano playing isn’t particularly efficient at doing so.
“…The two that are in middle school do not say anything about the masks because they fear reprimand. They FEAR standing up for themselves because they don’t want to get into any trouble…”
It’s so sad when youngsters feel like they can’t put their graduate degrees in epidemiology to practical use.
“…Mainly because we have taught them to obey the rules…”
So, then, no problem?

Subject: Waynesville IV-D district intent to not comply
Good evening,
I am writing to you this evening regarding Waynesville IV-D email of intent saying they will not be complying with your order. I have attached the correspondence from the district that was sent today.
Our problem with the Waynesville district is that it heavily impacted, heavily influenced, and heavily funded by the DoD being the district that supports our youth of Fort Leonard Wood. We can not escape theses tyrannical mandates and rules from the DoD, the poor Fort Leonard Wood leadership, the base, and then FLW leadership pushes these onto our school board/school administrators.
It is the school itself sir laying the rules, not following them themselves, yelling and bullying our children when they don’t have their masks perfectly adhered to their faces ALL day and we have had it. It’s bad enough we have middle school teachers assaulting 7th grade boys and our local prosecutors not taking action, teachers adding in non-approved CRT lessons, bullying our children over masks, poor and inadequate food choices for children even with additional federal funding… we have to deal with CONSTANT quarantine this, mask taht, social distance this, ‘GET AWAY FROM YOUR FRIENDS’ in the hallways that.
I can speak for a large group of parents in the Waynesville school district when I say we have had it and need someone that is not on the ‘good ole boy’ team down here to remind them they are not above the law.
[….]

So much for “support our troops.”
Wow, the Waynseville school district must have quite an advanced academic program if they can offer curriculum from graduate level law schools. Impressive.

Yes, since the AG seems to feel he is ‘qualified’ to make decisions on medical matters, I have multiple health questions I need answered, after all he seems to think he’s an expert.
1) I have started getting dizzy when I stand up, what should I do to prevent that?
2) I’ve noticed that since my last surgical procedure I have had some lingering pain and I’m unable to identify the source, it radiates from my LLQ, it’s throbbing, somewhat localized, and is concerning but more of a nuisance, what anti-inflammatory is best to reduce the pain?
3) It appears that my HTN is increasing with varying intenisty and frequency. I’ve attempted the usual statice treatments but the seem to be ineffective in the reduction of the diastolic numbers, what suggestions do you have? I’ve made multiple lifestyle changes already, I’ve cut Na, sucrose and fructose, I’m eating a plant based diet, I’ve increased physical activity to 10 min qID 7 days a week, yet it isn’t subsiding.
His expertise is greatly appreciated.

It was recently ruled by a judge that Lucas and the council members violated the law when he tried to take 40 million in police funding and move it to other areas, yet he remains in office. They have also stated that all city employees will be forced to get the vaccine or have to pay for WEEKLY test out of employee’s paycheck. Now one of the twins is home doing online school until the mask mandate is lifted, along with my younger child. They need school in a building. They want to go see their friends. I want to go back to the office. It really affects their health and breathing to have a mask all day, so I have to stay home. It took me 6 months to find a job I could do from home while they do school work. This has to end. Please, let me know if there is ANYTHING I can do to get this.

I have thought long and hard about safety policies in schools. Bottom line: In-person learning is vastly superior to online school. Masking keeps kids in school. I really don’t understand why you can’t handle that.

Subject: Mask mandates!
I favor mask mandates. Shame on you for using government resources for your pet MAGA project.
The thing that makes America truly great is when we observe our civic duty and look out for one another.
Now put on a mask and quit trying to prolong a fucking plague.
Sincerely,

Subject: My son [….]
Dear AG Schmitt,
Thank you for being a real life example to my son [….] You see, [….] is reading the George Orwell classic 1984, and he couldn’t believe anyone would call police to tell them their neighbors are committing crimes, but you have provided a real life example of government overreach for my son [….] Please go take a deep breath unmasked in a COVID ward.
Take care,

Quit being a political asshole. Our kids don’t mind wearing a damn mask. They are just happy to be in school.

Subject: Keep the mandates in place
I have three grandkids that can’t be vaccinated yet. The only way to help keep them safe AND in school is to have EVERYONE wear a mask. Missouri’s own study (you know the one Parson didn’t share with the cabinet) says the same thing. Masks reduce the number of cases.
Have to say, I’m pretty proud of myself for writing without including any of the four-letter words that were screaming in me to get out.
Do the right thing. NOT the thing that you think will get you votes.
“…I’m pretty proud of myself for writing without including any of the four-letter words that were screaming in me to get out…”
Others have stepped up to the plate.

Subject: Mask mandate in school
Good evening. I wanted to email and inform of my son’s school still enforcing the mask mandate in school, after school activities and on bus. This is Lindbergh school district, Dressel Elementary School.
Thank you for fighting for Missourians!! I’m so thankful we have you here in Missouri.
God speed Sir and God Bless America

I don’t think I’ve seen a politician go to such efforts to not do his current job while trying to get his next job. I sincerely will work more than I have before to ensure that you never hold public office. What a disgrace

Subject: Mask mandates
Our children deserve safe schools, and local school boards can decide what protocols are necessary for that purpose. Our state laws support this premise. Do your job correctly and please stop with the political grandstanding.

How dare you threaten the safety of our children and endanger the ability of our kids to access a public school eduaction? What a ridiculous waste of taxpayer resources. All because you have political ambition. You should really be ashamed of yourself.

Subject: Mask mandates
As a father of 2 young boys in public schools here in Missouri, its hard to understand the logic that clearly goes against reality and all data.
I’ve seen the effects of my children wearing masks for 2 school years now.
Neither of them have brought COVID home from school, not to mention any of the many respiratory virus or flu that are spread every other year that masks are not enforced.
2 full years of research data makes it abundantly clear that masks reduce the spread of this lethal virus.
Your ignorance of facts and reality ensure that you will not receive my families vote in any future election.
Please resign
Thanks.

Subject: Mask Mandates are Common Sense
As COVID-19 cases in Missouri soar, schools that mandate masks are looking out for the health of their students, teacher, and communities.
The Governor’s own study showed that mask wearing protected community spread of this horrible disease.
Be a leader and stop spreading lies and anti science rhetoric. Your behavior is embarrassing our state.

There are 8000 pages in the four files. I haven’t been able to access about half of the pages (in the largest single file). If I make it that far I’ll ask for that portion of the documents in a subsequent RSMo § 610 “Missouri Sunshine Law request.
At this point I’ve gone through about one-eighth of the total 8000 pages. What I haven’t posted is a considerable amount of monkeywrenching spam subscriptions and other emails reporting schools or school districts with multiple pages of “evidence” in the form of documents and school or school district web sites.
Think about that for just a second. A significant number of our neighbors have been eagerly submitting their “research” and “evidence” to an agent of the state with the explicit purpose of punishing their local schools, teachers, and school administrators.
They have a long plan. It is to undermine public confidence and support for public schools. Once that public supprot is gone public school resources will be divided up and tossed to private for-profit entities. If you’ve been reading these emails you’ll note that even parochial schools aren’t safe. This was best illustrated in a comment in an email [not published here] complaining about masking in parochial school and blaming a “liberal priest.”
Another thing that comes across in some of the narratives supplied by the anti-mask, anti-scince crowd is the professionalism and patience of teachers and school administrators as they deal with self-centered fools. It’s also painful. School adminstrators and teachers have enough on their plates these days without having extremist assholes sending in their children to provoke confrontations. Yes, even children of kindergarten age. What kind of parent even contemplates doing this?

Missouri Attorney General Eric Schmitt’s (r) anti-mask public school complaint email address: illegalmandates@ago.mo.gov
On Thursday afternoon we received a response from the office of Missouri Attorney General Eric Schmitt (r) complying with our December 9th RSMo § 610 “Missouri Sunshine Law” request for the contents of the illegalmandates@ago.mo.gov email address set up by the Attorney General to solicit complaints about mask wearing in Missouri public schools.
