Basically comes down that Gardner was endorsed as witness. Gardner couldn’t proceed with case. Will refile w/ special prosecutor.

Update II:

The circuit attorney (prosecutor Kim Gardner) in her statement said that she had to do so because the judge had allowed the defense to call her as a witness. She stated that she will seek another avenue (special prosecutor) to refile the charges.

Someone in the House side gallery quipped as this bill was brought up, “Ah, the Eric Greitens bill.”

On a corner of E. Capitol Avenue and Madison Street.

Late this afternoon the House took up a bill on the subject of “private sexual images”, making the unauthorized distribution of those images by another party a class D felony. This practice is also known as “revenge porn”.

The bill, back from the Senate, was handled on the House floor by Representative Jim Neely (R):

The House discussed and voted on an emergency clause for the bill which would make the bill law immediately upon signing by the governor (or after a period, without his signature and without his veto). The discussion was about if the passed bill would be forwarded to the governor immediately. The Speaker took to the floor of the House to answer that inquiry.

Yesterday the General Assembly filed a petition [pdf] for a special session with the Secretary of State:

Missouri General Assembly

PETITION FOR SPECIAL SESSION OF THE MISSOURI GENERAL ASSEMBLY

WHEREAS, Article III Section 20(b) of the Constitution of Missouri provides that “upon the filing with the secretary of state of a petition stating the purpose for which the session is to be called and signed by three-fourths of the members of the senate and three-fourths of the members of the house of representatives, the president pro tem of the senate and the speaker of the house shall by joint proclamation convene the general assembly in special session.”

We, the undersigned, constituting at least three-fourths of the members of the Senate and at least three fourths of the members of the House of Representatives pursuant to Article III, Section 20(b) of the Constitution of Missouri, hereby call a special session of the General Assembly to convene at 6:30 p.m. on May, 18, 2018, for the sole purpose of considering the findings and recommendations of the House of Representatives Special Investigative Committee on Oversight including, but not limited to, disciplinary actions against Governor Eric R. Greitens.

Yesterday both houses of the Republican controlled Missouri General Assembly submitted a sufficient number of signatures to call for a special session to consider the impeachment of Governor Eric Greitens (r). The special session will begin at 6:30 p.m. on May 18th, after the end of the current regular session.

Missouri Lawmakers Will Hold Special Session To Consider Impeaching Governor

Missouri lawmakers say they will convene a special legislative session to consider impeaching Missouri Gov. Eric Greitens, as the embattled governor faces two felony charges.

“This was not a decision made lightly, and certainly not without great deliberation and effort,” House Speaker Todd Richardson, R-Poplar Bluff, told reporters Thursday.

Richardson said 138 members of the House and 29 senators had signed a petition to call the special session — more than the three-quarters of each chamber that is required to convene the session.

Missouri currently has 161 House members and 33 senators — a solid majority of them Republican. Republicans hold 114 of the House seats and 24 in the Senate.

The special session is scheduled to begin the evening of May 18, which is the last day of the legislature’s regular session, and will last for 30 days.
