“Could a President order seal Team 6 to assassinate a political rival?” Judge Florence Pan, of the U.S. Court of Appeals for the D.C. Circuit, asked D. John Sauer, a lawyer for Donald Trump, in oral arguments on Tuesday. It was a remarkable question for a remarkable political moment, and one that has been a long time coming. Pan was one of three judges on an appeals panel hearing Trump’s argument—which seemed, in varying degrees, to appall them—that the case brought against him by the special counsel, Jack Smith, related to Trump’s actions in the run-up to the assault on the Capitol on January 6, 2021, should be thrown out. Trump contends that, in the absence of an impeachment conviction, he is absolutely immune from prosecution for acts related to his official duties as President. Hence Pan’s question about an assassination. “That’s an official act, an order to seal Team 6,” she pointed out.

Sauer stalled and tried to qualify his answer by saying that such a President would need to be, and indeed “would speedily be,” impeached. Pan interrupted to say that that was more easily said than done. “I asked you a yes-or-no question,” she tried again. “Could a President who ordered seal Team 6 to assassinate a political rival, who was not impeached—would he be subject to criminal prosecution?”

“If he were impeached and convicted first,” Sauer said.

“So your answer is no,” Pan said.

Anti-mifepristone argument too dumb for even Trump nominees to stomach

Where the law is determinate, judges will ignore it only when they have very strong policy preferences and the arrogance to believe they trump everything. In the mifepristone case, it looks like only Alito and perhaps Thomas will fall into this category…

Republicans will let a woman die from sepsis before letting her have an abortion, they’ll teach a child to tourniquet before banning AR-15s, and they’ll let 8 MILLION kids go hungry instead of giving them free food, but they’re marching to prove just how “pro-life” they are.

Being supportive of life would be providing the care timely care, for All Veterans. Being supportive of life would be passing laws that ensured ALL individuals enjoy ALL RIGHTS, EQUAL RIGHTS.
You do not support life. You support control, over women and anyone not just like you.

…The name-brand drug Mifeprex was first approved by the Food and Drug Administration more than 20 years ago. Since then, it has been used millions of times, and major medical groups say it has a strong safety record. A generic version was approved in 2019.

Now, the drug’s future is in jeopardy. A federal judge in Texas issued a preliminary injunction that undoes the FDA’s approval of mifepristone nationwide beginning this Friday….

Federal judge in Texas hears case that could force a major abortion pill off market

A coalition of anti-abortion medical groups and doctors called the Alliance for Hippocratic Medicine sued the FDA back in November, saying the abortion pill mifepristone was improperly approved two decades ago as part of a two-drug protocol that’s used to end pregnancies in the first trimester.

Erin Hawley, an attorney representing Alliance for Hippocratic Medicine, argued that doctors who are part of this group have been forced to treat patients who have experienced complications, which can include heavy bleeding. In some cases, Hawley said, doctors have been forced to provide a surgical procedure to complete the abortion, despite their deeply held beliefs.

As a Texas federal judge deliberates his decision in a high-profile case that could impose a nationwide ban on a leading abortion drug, reproductive rights activists are now raising scrutiny about a member of the plaintiffs’ legal team: Erin Morrow Hawley, an attorney and the wife of Missouri senator Josh Hawley.

The case, which is playing out in a courtroom in rural Texas, could have the most far-reaching ramifications on abortion access in the United States since the fall of Roe v. Wade. Should the judge, Matthew Kacsmaryk, rule in favor of the plaintiffs in the case and issue a preliminary injunction, it could effectively block the use of mifepristone, one of two drugs used in medication abortions, which account for more than half of all abortions in the US. Hawley is one of the main lawyers arguing on behalf of conservative legal organization Alliance Defending Freedom, which sued the Food and Drug Administration last November for its approval of the abortion medication.

Hawley’s name is all over a nationwide effort to ban abortion without exceptions.
