Tax Cuts and Jobs Act of 2017 (TCJA)

The Tax Cuts and Jobs Act of 2017 (TCJA) is the unofficial name for the large set of changes to the Revenue Code of 1986, signed into law by President Trump in 2017. TCJA made many large changes across multiple areas of the tax code, including most infamously reducing the corporate tax rate, increasing the standard deduction, and increasing the applicable exclusion amounts for estate taxes. Only some of the TCJA changes were permanent, and over twenty provisions will expire by the end of 2025.

For individual tax deductions, the TCJA reduced some of the overall tax rates and changed many deductions. [….] All of these changes will revert back to their pre-TCJA provisions after 2025. [….]

The prohibition of the theft and hoarding of classified documents (along with other publically owned materials) in the law applies to everyone.

…This appeal requires us to consider whether the district court had jurisdiction to block the United States from using lawfully seized records in a criminal investigation. The answer is no.

Former President Donald J. Trump brought a civil action seeking an injunction against the government after it executed a search warrant at his Mar-a-Lago residence. He argues that a court-mandated special master review process is necessary because the government’s Privilege Review Team protocols were inadequate, because various seized documents are protected by executive or attorney-client privilege, because he could have declassified documents or designated them as personal rather than presidential records, and—if all that fails—because the government’s appeal was procedurally deficient. The overnment disagrees with each contention.

In considering these arguments, we are faced with a choice: apply our usual test; drastically expand the availability of equitable jurisdiction for every subject of a search warrant; or carve out an unprecedented exception in our law for former presidents. We choose the first option. So the case must be dismissed…

…Indeed, Plaintiff does not press the district court’s theory on appeal. Instead, he argues that the Presidential Records Act gives him a possessory interest in the seized documents. This argument is unresponsive. Even if Plaintiff’s statutory interpretation were correct (a proposition that we neither consider nor endorse), personal interest in or ownership of a seized document is not synonymous with the need for its return.3 In most search warrants, the government seizes property that unambiguously belongs to the subject of a search. That cannot be enough to support equitable jurisdiction….

(footnote) 3 During discussion of this factor at oral argument, Plaintiff’s counsel noted that the seized items included “golf shirts” and “pictures of Celine Dion.” The government concedes that Plaintiff “may have a property interest in his personal effects.” While Plaintiff may have an interest in these items and others like them, we do not see the need for their immediate return after seizure under a presumptively lawful search warrant.

….Having failed to show his own need, Plaintiff attempts—as he did in the district court—to reverse the standard, arguing that the government does not need the non-classified documents for its investigation. This is not self-evident, but it would be irrelevant in any event. Plaintiff’s task was to show why he needed the documents, not why the government did not. He has failed to meet his burden under this factor….

….Plaintiff’s alternative framing of his grievance is that he needs a special master and an injunction to protect documents that he designated as personal under the Presidential Records Act. But as we have said, the status of a document as personal or presidential does not alter the authority of the government to seize it under a warrant supported by probable cause; search warrants authorize the seizure of personal records as a matter of course. The Department of Justice has the documents because they were seized with a search warrant, not because of their status under the Presidential Records Act. So Plaintiff’s suggestion that “whether the Government is entitled to retain some or all the seized documents has not been determined by any court” is incorrect. The magistrate judge decided that issue when approving the warrant. To the extent that the categorization of these documents has legal relevance in future proceedings, the issue can be raised at that time….

….The law is clear. We cannot write a rule that allows any subject of a search warrant to block government investigations after the execution of the warrant. Nor can we write a rule that allows only former presidents to do so. Either approach would be a radical reordering of our caselaw limiting the federal courts’ involvement in criminal investigations. And both would violate bedrock separation-of-powers limitations. Accordingly, we agree with the government that the district court improperly exercised equitable jurisdiction, and that dismissal of the entire proceeding is required.

The district court improperly exercised equitable jurisdiction in this case. For that reason, we VACATE the September 5 order on appeal and REMAND with instructions for the district court to DISMISS the underlying civil action.

How about all the corporations who get tax breaks? Is it fair to the ones that don’t, or to the people that subsidize it? I eagerly await your response.

What’s not fair are usurious student loans that compound monthly, making them virtually impossible to pay off. If Republicans in Congress would stop blocking banking reform, we could change this. Until then, forgiving these loans for people earning less than $125K/year is fair.

Nonsense anybody older than 50 went to school when the government subsidized 75% of tuition costs. Ronald Reagan eliminated that and he also cut back on how easy it was to get Pell Grants and cut back on getting direct government loans pushing people into banks if they wanted to

Josh, your private high school costs $15,000/year. Did your family take out loans to pay for that? What’s that? No? Ahh, I see how it is.

Did your family take out loans for Stanford ($56k/year)?

How about Yale Law School ($60k/year)? Did you incur any debt at all?

Oh just stop. I paid mine off… but the interest rate was low (1.5%). It’s not the same thing. These kids are making their payments, paying back more than they borrowed and end up with a balance that is 2x what they borrowed. This isn’t a loan, it’s indentured servitude.

How pathetic of you. It’s hard out there for people. The predatory terms of these loans traps people in poverty. Keep running your mouth just like you run for your life down the halls of the Capitol.

Why do you assume that this isn’t helping working people, Josh? Is it because you spend so much time making sure rich people & corporations get all the breaks that you’re out of touch with working class people in the state you “represent” but can’t be bothered to live in?

I am thrilled if some of my taxes go to cancelling student debt. I feel I’ve been blessed, and I should share the wealth with those NOT so blessed. Why don’t YOU feel that way?

Why do Republicans hate higher education so much?

The people with student loan debt did, “play by the rules” – they worked hard and went to college. They probably worked summers and part times jobs during the school year, too. This is something coming from a YALE and STANFORD graduate.

Hey Josh. Missouri voter here. I’ve never voted for you and I never will. My son & d-in-law will benefit from this. Do you know what will happen to the money they save from this? Build a home, buy a car, pay for their child’s education. It all gets reinvested into the economy.

Is this where I get to decide which government programs I don’t want to pay for because they don’t benefit me personally? Cuz I got a list.

by rules you mean wealthy parents? a trust fund? good enough mental and physical health to work 2 jobs? willingness to forgo healthcare to pay for school? No need for childcare? Because those are the rules that allow people to get higher education and not go into debt.

I’m a parent who helped 3 children get through college w/no loans. Our family made choices and sacrifices to do that. I LOVE this! I wish Biden’s plans went further. What happened to our sense of community? Is your entire philosophy, “What’s in it for me?”

Dear Representative Loudermilk:

On May 19, 2022, the Select Committee invited you to meet with us about evidence of a tour you provided on January 5, 2021. Based on our review of surveillance video, social media activity, and witness accounts, we understand you led a tour group through parts of the Capitol complex on January 5, 2021. That group stayed for several hours, despite the complex being closed to the public on that day.

Surveillance footage shows a tour of approximately ten individuals led by you to areas in the Rayburn, Longworth, and Cannon House Office Buildings, as well as the entrances to tunnels leading to the U.S. Capitol. The below image shows you leading individuals on the tour:

Individuals on the tour photographed and recorded areas of the complex not typically of interest to tourists, including hallways, staircases, and security checkpoints. [….] For example, the below image shows an individual appearing to photograph a staircase in the basement of the Longworth House Office Building while you speak with others nearby:

The below image shows members of the tour you led also taking photographs of the tunnel leading from the Rayburn House Office Building to the Capitol:

The behavior of these individuals during the January 5, 2021 tour raises concerns about their activity and intent while inside the Capitol complex.

The Select Committee has learned that some individuals you sponsored into the complexattended the rally at the Ellipse on the morning of January 6, 2021. According to video recordings from that day obtained by the Select Committee, the individual who appeared to photograph a staircase in the Longworth House Office Building filmed a companion with a flagpole appearing to have a sharpened end who spoke to the camera saying, “It’s for a certain person,” while making an aggressive jabbing motion. Later, these individuals joined the unpermitted march from the Ellipse to the U.S. Capitol. While standing near the Capitol grounds, the same individual made a video that contained detailed and disturbing threats against specific Members of Congress. For example, as the individual filmed the march to the Capitol, he said, “There’s no escape Pelosi, Schumer, Nadler. We’re coming for you.” As he looked up at the Capitol, he went on:

[“]They got it surrounded. It’s all the way up there on the hill, and it’s all the way around, and they’re coming in, coming in like white on rice for Pelosi, Nadler, even you, AOC. We’re coming to take you out and pull you out by your hairs. … When I get done with you, you’re going to need a shine on top of that bald head.[“] [….]

While we had hoped to show you the video evidence when you met with us, and since you have thus far declined, the Select Committee provides the video in question for your review [….].

The foregoing information raises questions the Select Committee must answer. Public reporting and witness accounts indicate some individuals and groups engaged in efforts to gather information about the layout of the U.S. Capitol, as well as the House and Senate office buildings, in advance of January 6, 2021. For example, in the week following January 6, 2021, Members urged law enforcement leaders to investigate sightings of “outside groups in the complex” on January 5, 2021 that “appeared to be associated with the rally at the White House the following day.” [….] The Select Committee’s review of urveillance footage showing the above-described tour is consistent with those observations. [….]

We again ask you to meet with the Select Committee at your earliest convenience.
