Missouri clinics will ‘immediately’ offer abortion across the state after judge’s ruling
A judge ruled the state’s abortion clinic licensing requirements were ‘discriminatory,’ opening the door for providers to renew access to the procedure

A Missouri judge on Friday blocked a licensing requirement for abortion clinics that providers argued was a key obstacle to renewing access to the procedure across the state.

Hours later, Planned Parenthood clinics announced they would begin offering abortion services in Missouri.

“Abortion care will be restored immediately,” said Emily Wales, President and CEO of Comprehensive Health of Planned Parenthood Great Plains. “The people voted, the court responded and we will do our part: serving Missourians in their home state.”

In a three-page ruling issued late Friday afternoon, Jackson County Circuit Court Judge Jerri Zhang said the regulations mandate physicians to perform certain exams and testing that are “unnecessary.”

The licensing requirement is “discriminatory,” Zhang wrote, “ because it does not treat services provided in abortion facilities the same as other types of similarly situated health care, including miscarriage care.”

Planned Parenthood clinics had previously said it could begin taking walk-in medication abortion appointments in Kansas City, Columbia and St. Louis if the judge ruled in their favor.

HJR 54 is an attempt to overturn the voters’ approval of Amendment 3 in the November general election – abortion rights now in the Missouri Constitution [Bill of Rights – Section 36].

The summary:

HJR 54 [pdf]– REPRODUCTIVE HEALTH CARE

Upon voter approval, this constitutional amendment prohibits abortions, except in cases of medical emergencies, fetal anomalies, rape, or incest. In the case of abortions performed or induced because of rape or incest, the abortion may be performed or induced no later than 12 weeks gestational age of the unborn child and only if documentation is presented to the attending physician that the rape or incest has been reported to a law enforcement agency that has jurisdiction to investigate the complaint at least 48 hours prior to the abortion.

The amendment also prohibits public funds from being used to pay for abortions; prohibits the use of surgeries, hormones, or drugs to assist a child with a gender transition; and holds that any person who intentionally or negligently causes damage to another person relating to the provision of reproductive health care or the performance or inducement of an abortion is liable for damages and subject to suspension or revocation of his or her medical license. Under this constitutional amendment, a woman’s right to reproductive freedom includes the right to health care in cases of miscarriages, ectopic pregnancies, and other medical emergencies. The General Assembly will have the authority to enact laws to carry out these provisions.

I am support of protecting women and their right to reproductive healthcare!!!!!

My body, my choice. Period.

I feel that it should be up to a woman to decide what she wants to do with her body. The state nor the government should be able to dictate what she should do. Reproductive care should be allowed and provided as well as encouraged for the well being of every woman.

I support reproductive rights and bodily autonomy. Outside of any definition of “life”, outside of even the fact that we can’t force people to be organ donors in life or in death even if it could save lives (nor should we force people to), there should be a separation of church and state and it’s immoral and illegal to try to control and rule over people by your specific christian rules. christianity is not fact, not should it be law. While christians are more than welcome to live their lives by these rules (rules not provided by the Bible, I KNOW y’all aren’t reading it), you don’t get to force others to.

All women should have control over their own body and health.

I voted yes on amendment 3

Every person, including women, in this country should have the right to make decisions concerning their body. The notion that women should be given less rights is complete lunacy. The voters in this State made their opinions known when they cast their ballot. Let the people’s decision stand.

I am submitting this testimony to express my strong opposition to HJR 54. This resolution not only threatens the reproductive rights of Missourians but also risks putting lives in danger and deepening existing inequalities in our state. Abortion is a deeply personal and often difficult decision that should be made by individuals in consultation with their doctors—not dictated by politicians. People seek abortions for many reasons, including life-threatening medical conditions, financial insecurity, or knowing that they are not in a place to provide for a child. These decisions cannot and should not be reduced to political talking points. The provision in HJR 54 that allows for exceptions in cases of rape or incest may seem compassionate on the surface, but it is anything but. It requires survivors to report their abuse and provide documentation—despite the fact that many victims are unable to safely report their abusers, especially if those abusers are family members or individuals with power over them. Even for those who do report, investigations can drag on for months or even years, far exceeding the 12-week cutoff. This effectively denies survivors the care they need and deserve. But the issues with HJR 54 go beyond just one provision. Abortion restrictions like this one overwhelmingly harm people who are already vulnerable. Those living in rural areas, people of color, and low-income individuals often have limited access to healthcare to begin with. For these communities, banning abortion doesn’t just limit choices—it creates life-threatening obstacles. Let’s be clear: Amendment 3 reflects the values and decisions of Missouri voters. Repealing it would ignore the will of the people and undermine their trust in the democratic process. Missourians deserve access to compassionate, safe, and respectful healthcare, free from unnecessary barriers or government interference. I urge you to reject HJR 54 and uphold the protections established by Amendment 3. Thank you for taking the time to consider my testimony.

I am nearly 80 years old. For 50 years of my life, women have had the right to make decisions about their reproductive health. The voters have spoken and the will of the people should be respected and upheld.

Support abortion choice in Missouri – 1,538,659 Missourians voted YES on Amendment 3–you were elected to defend those rights – Reproductive Freedom is a Missouri value – Missourians made it clear at the ballot: we support access to abortion and all reproductive health care; our government should reflect those shared values not threaten them

Access to reproductive care is ESSENTIAL to the health of women and families. Any restrictions, whether gestational timeline, reason for need of care, or others, is a detriment to women. This is about medical care which should be decided by a woman and her doctor, not a politician. If a woman’s morals, religion, or social stance lead to a decision in the case of an abortion, that is her right. Allowing exceptions to care only muddies the waters when it comes to TIMELY and safe reproductive care. Ignoring the vote of the people is absolutely abysmal and it’s embarassing that we are, once again, having to defend our own rights as human beings.

This has been voted on & settled. Isn’t that the point of “sending it back to the states” so do what we voted for.

[….] I’m a wife, mother and a woman who believes in access to healthcare for all. 1,538,659 Missourians voted YES on Amendment 3, you were elected to defend those rights.Reproductive Freedom is a Missouri value. Missourians made it clear at the ballot: we support access to abortion and all reproductive health care; our government should reflect those shared values not threaten them.For a party that preaches small government, when we tell you to stay out of our bedrooms, doctors offices and medical care—we mean it.

[….] I voted to legalize abortion is Missouri. This is a vote I expected to be honored and respected. This is a moment for Missouri politicians to prove they are a voice for the people by executing the amendment the majority voted for.

I have needed life saving reproductive healthcare that without it I would have died. Amendment 3 is vital to protecting women from death during pregnancy and childbirth. Voting to overturn something that the voters put into place is disposable. The lawmakers are supposed to be upholding what their constituents want- and there is no more direct way to know what the constituents want than upholding their vote. Do not repeal amendment 3!

I support reproductive health care and allowing the choice to be left up to each individual. Pro choice!!! We voted in it and it passed. You cannot remove our votes because you don’t like the results.

Yet they keep trying.

I voted for amendment 3 and expect that it be enforced not over ridden by ignorant people, mostly men who have no understanding of how important it is to getting access to good reproductive medical health care for your body as well as allowing responsible doctors to save people’s lives if an abortion is necessary. To not enforce what Missouri’s overwhelmingly voted for is against every democratic process there is…

[….] It’s not complicated. I’m in full support of abortion because it is absolutely a woman’s right to have full control and rights over her body. It should not be up for debate, nor should it be regulated in anyway by religious or government body doctrine.

I fully support reproductive healthcare in our wonderful state of Missouri. Women’s reproductive freedom will benefit women, men and children in a positive mental, emotional, physical a d economic way. As a community college teacher I work with scores of young men and women who agree and wish for the guarantee of this freedom for our future. They express how disheartened and disenfranchised they feel in our political climate. I submit this testimony in solidarity with them and for myself and my family – children and grandchildren. We are not going back!

“We will not go back”

You wanted this to be a state issue. You wanted the people of the state to decide. We voted and 1,538,659 people voted yes to reproductive freedom. Your job, as elected officials, is to uphold the will of the people. This no longer up debate.

The State of Missouri voted to uphold abortion in our state and now there is a push to again deny the will of the voters. This is a gross miscarriage of justice. Stop trying to impose your will on the people who clearly told you, No. Abortion is a woman’s choice and right. It is reproductive care. It is NONE of your business. It is NOT up to you too change the will of your constituents [….]

I support the repeal of Amendment 3 and wish to impose the restrictions outlined in HJR 54.

Believe them when they tell you what they want to do.

As a mother of 4 children of 10 grandchildren I am in favor of ending killing babies and selling of infant body parts for profit. I am a concerned citizen,voter and Grandmother. Please stop!

Abortion is healthcare! Keep your laws off my fucking body!

I am in favor of repealing Amendment 3. It was and is a terrible bill and use or State of Missouri as a “trail balloon” for other states. This needs to be repealed ASAP. Children / Babies have a right to be born. We give more rights to dogs than humans.

I support HRJ 54 that it be passed to abolish Amendment 3. Passage of Amendment 3 is such a stain on our pro-life state of Missouri. God will not bless our state with such a law in our constitution. So many babies are murdered and the many of these mothers experience a lifetime of pain and guilt. It is time to promote and encourage women to keep their babies and to show women how to cherish and love their babies instead of encouraging women to choose a way out of their pregnancies.

I voted along with a majority of Missourians for the reproductive choice bill. Why are we still fighting over this.?

“54 years ago…”

I want my November vote to be honored as a voting citizen. Women have a right to seek the care they require. I didn’t vote for this governor, yet I am expected to accept the election results. I now expect the same on womens rights and protections

Why would you undermine the will of the people in Missouri? Reproductive health care is health care. proposition passed and should remain intact without politicians trying to overturn this to stay in power. I am in support of reproductive freedom and body autonomy. It’s sickening to see politicians pretend the country would be better by repealing the will of the people.

Missourians like me and my family are tired of our elected representatives attempting to circumvent the will of the voters. We stand in support of Amendment 3, which enshrined reproductive freedom and AGAINST HRJ 54. Legislators who cannot support the law and uphold the votes of their constituents do not belong in the Missouri State House. This matter is decided. Can you please move on to real issues, like improving education, healthcare, and bringing new businesses to our state? The quality of life in Missouri continues decline and you do NOTHING to make our state a better place and support families and children. We continually rank at the bottom of important quality of life indices as compared to other states. We also stand against HRJ 54’s prohibitions regarding gender affirming care. Let parents and their medical professionals decide what’s best for their children. The government does not belong in private healthcare matters of any kind. Thank you.

I am appalled that the will of the people of Missouri is being blatantly ignored. The citizens of this state have already made their wishes known: reproductive rights and freedoms are to be made available to any pregnant person in the state of Missouri. It is also incredibly infuriating that this proposal not only seeks to go against the vote of Missourians but also ties the rights of transgender people into this argument. They are two completely different issues and should remain as such.

The state of Missouri has already voted and decided to continue reproductive rights in favor of abortion. This is ridiculous and goes against what the people voted for.

I’m struggling to understand the desire to move to a minority rule mentality, as we as a State had this as a ballot measure that had the support and won in November. This desire to move to a world where if you lose, you deny the results, you deny the selection of the people that put you in/out of power is not only problematic, it’s not how the system is suppose to work. We the people vote, you perform for the will of the people. We need to be adults, accept when you lose and win with grace.

Yet, here we are.

Missourians already voted and expect that our representatives will honor our vote to protect abortion rights in our state. Your job is to serve the people, so please stop trying to negate their voice.

As a woman in the state of Missouri i want amendment 3 defended. I do not support HJR 54. I do not support losing my right to a safe legal abortion. I’m tired of having to continue this fight. I deserve bodily autonomy and so does every other woman.

Despite voicing opposition to abortion, most members of the Rolla City Council worried the ordinance would do little besides inspire costly litigation

The mayor remained skeptical from the start.

“It’s not clear to me why Rolla needs to carry this banner when the problem, whether it’s the attorney general, the governor or whoever the hell else is up there, they need to sort this out,” Magdits said last month. “I don’t think it’s Rolla, Missouri’s responsibility to lead this charge.”

His opinion seemed to change little on Monday.

In fact, Dickson said after the meeting, Magdits “threatened to cut my nuts off” after he accused Magdits of siding with Planned Parenthood, even though Magdits during the meeting expressed frustration that Amendment 3 even made it on the ballot.

The Independent could not immediately reach the mayor for comment, but Rolla City Administrator John Butz confirmed he overheard part of the conversation.

“I was there and I heard it,” Butz said. “I think in the context the mayor wasn’t threatening him per se with that, I think it was in the side conversation the two of them were having. So I’ll leave it up to them to comment on the intent or the context of what was said.”

Re: Consideration of Rolla as a “Sanctuary City for the Unborn”

It has come to our attention that Rolla’s City Council is considering a “Sanctuary City for the Unborn” ordinance. The ACLU of Missouri strongly recommends that the Council decline to act on this proposal and reject the ordinance in its entirety. The proposed ordinance is clearly invalid under Missouri statute and the Missouri Constitution and will result in costly litigation. Article I, Section 36 of the Missouri Constitution prohibits the government from infringing on the fundamental constitutional right to reproductive freedom, which includes the right to make and carry out all decisions related to abortion care. Section 36 applies not only to the State of Missouri, but to municipalities like the City of Rolla. See Mo. Const. Art. I, § 36.8. Additionally, Section 188.010 of Missouri’s Revised Code further preempts local abortion restrictions, including those under consideration by the Rolla City Council.

While the draft ordinance claims to ensure “compliance” with federal laws, including the Comstock Act, it instead imposes requirements that conflict with how courts and the Department of Justice (DOJ) have long interpreted the Comstock Act. As set forth in a lengthy analysis by the DOJ’s Office of Legal Counsel, courts have consistently held that the Comstock Act does not apply to drugs and articles sent and received for lawful abortions.1 Congress has ratified this limiting interpretation, and the DOJ has endorsed it. Therefore, this ordinance is not about “compliance” with federal law but rather about imposing a misguided interpretation, which contradicts established legal precedents and Congressional intent.

Additionally, the proposed ordinance could have severe repercussions beyond abortion access particularly in the realm of reproductive healthcare. Medications like mifepristone and misoprostol, as well as instruments used in procedural abortion care, are critical for numerous aspects of reproductive health care, including managing miscarriages. The language of the ordinance could authorize lawsuits against hospitals and other providers receiving these materials for numerous healthcare services, including miscarriage management, even when abortion is not involved. Since the medications and other materials used by healthcare providers to treat patients experiencing miscarriages, as well as many other health conditions, were—under the draft ordinance’s terms—“designed” for abortion care, “adapted” for abortion care, and/or “described in a manner calculated to lead another to use or apply it for producing abortion,” this ordinance poses a significant risk of undermining essential medical care, including for individuals experiencing miscarriages in emergency situations. The consequences could jeopardize women’s healthcare broadly, not just constitutionally protected abortion care.

A municipality cannot override the Missouri Constitution or ignore the will of Missouri voters who have established clear protections for reproductive freedom. The proposed ordinance is not only an overreach of local authority but also a threat to the health and well-being of Rolla residents.

We strongly encourage the Council to respect the will of the people, legal realities, and medical realities governing reproductive healthcare in Missouri. Rejecting this ordinance would demonstrate the City’s commitment to upholding the law and prioritizing the health and well being of its community.

Attempting to impose such a measure would invite expensive legal challenges, divert valuable city resources, and, most importantly, cause unnecessary harm and delay to individuals in need of critical healthcare.

The ACLU of Missouri urges the Council to consider the best interests of its citizens and comply with its constitutional obligations. In the meantime, we will be closely monitoring the proposed ordinance.

Rolla rebukes groundbreaking anti-abortion ordinance, for now

Rolla City Council on Monday rebuked an attempt by one of its aldermen to make the city the first in Missouri to adopt an ordinance that would make it a so-called “Sanctuary City for the Unborn.”

Alderman Josh Vroman has been working with anti-anbortion advocates in Texas and St. Louis to move the legislation forward. He withdrew the legislation from consideration after criticism from several members of the council. Vroman said he would bring a new draft of the ordinance to the council in the coming weeks.

The Sanctuary City for the Unborn organization has helped more than 60 cities in Texas, Ohio, Illinois, New Mexico and Nebraska adopt ordinances restricting access to abortion services at the municipal level.

Rolla would be the first in Missouri, and Mayor Lou Magdits said he doesn’t want to see that happen.

“Nobody else in the state has done this. So what does that tell me? It tells me we’re about to be used,” he said. “And that’s the part that I really feel uncomfortable with.”

There is an issue being discussed by the Rolla City Council that we would like to make you aware of.

Some members of the City Council are interested in declaring Rolla a “Sanctuary City for the Unborn”, and as such, taking away some of the reproductive rights that were supported by the majority of voters at the November 5th election when Amendment 3 was passed.

If this is an issue that is important to you, please consider going to the Monday, January 6th City Council meeting at Rolla City Hall, 901 North Elm Street, Rolla, MO at 6:30 pm. There might be a big crowd, so please come early. Planned Parenthood is requesting that supporters of keeping our reproductive rights wear pink.

Our City Council needs to know that they are not supporting the will of the people by trying to impose an ordinance that could limit the availability of reproductive rights that were just approved by the voters.

“….However, the practical effect of the decision is that no health center in the state can restart abortion services because none has an abortion license, or can get one under the state’s draconian requirements. The vast majority of Planned Parenthood health centers cannot comply with the medically irrelevant size requirements for hallways, rooms, and doors—and no health centers are able to comply with an equally irrelevant, invasive vaginal exam for patients seeking medication abortion. Yesterday, in the Jackson County Circuit Court a significant number of TRAP laws (“targeted regulation of abortion providers”) in Missouri statutes were enjoined. However, certain restrictions remain in place, creating barriers to the resumption of women’s reproductive health and abortion rights in Missouri as guaranteed in Amendment 3 which was approved by Missouri voters in November.

Yesterday, from Planned Parenthood – Great Plains:

Two weeks after Amendment 3 takes effect, Planned Parenthood providers remain unable to restart abortion care due to court order allowing multiple TRAP laws and other restrictions to stay in effect

Missourians remain unable to exercise their constitutional right to abortion under Amendment 3 at Planned Parenthood clinics after a Jackson County circuit court judge issued a mixed decision that leaves in place numerous abortion restrictions. While Planned Parenthood stands ready to start providing abortions in Missouri again as soon as the Court permits, the abortion restrictions remaining in effect – including Missouri’s medically unnecessary and discriminatory clinic licensing requirement – make this impossible.

As a result of today’s mixed decision, Missourians continue to be deprived of time-sensitive, essential, and constitutionally protected health care, despite voting in favor of a constitutional right to abortion.

In a win for abortion rights, the court enjoined the state’s abortion bans, including the Total Ban, as well as the vast majority of the TRAP laws Plaintiffs challenged, including the 72-hour mandated delay period, biased information requirements, and hospital admitting privileges.

However, the practical effect of the decision is that no health center in the state can restart abortion services because none has an abortion license, or can get one under the state’s draconian requirements. The vast majority of Planned Parenthood health centers cannot comply with the medically irrelevant size requirements for hallways, rooms, and doors—and no health centers are able to comply with an equally irrelevant, invasive vaginal exam for patients seeking medication abortion. Plaintiffs will continue to fight to see that these restrictions are enjoined.

The licensure requirement also leaves Planned Parenthood facilities at the whim of anti-abortion officials in Missouri, who can continue to weaponize the licensure process to limit abortion access, as they have done for decades. In 2019, for example, the Department of Health and Senior Services used facility licensure as the tool to target the last-remaining abortion facility in the state in an attempt to eliminate all abortion access. The effort was later rejected by the State’s Administrative Hearing Commission. During this process, the Department invented a new requirement that patients seeking medication abortion must submit to a medically unnecessary invasive vaginal exam. It was revealed during that litigation the Health Director maintained a spreadsheet of Planned Parenthood patients’ menstrual cycles.

The health care providers who filed the challenge, Comprehensive Health of Planned Parenthood Great Plains and Planned Parenthood Great Rivers–Missouri, would have been able to immediately resume abortion care if the court had granted the requested preliminary relief. Plaintiffs are evaluating their legal options, as they vow to continue fighting to fulfill the promise of Amendment 3 and restore abortion access in Missouri.

“It is unacceptable that tomorrow, just like for the past two weeks, Missourians will have a constitutional right that cannot be realized in their home state,” said Emily Wales, president and CEO of Comprehensive Health of Planned Parenthood Great Plains. “We’re relieved the court recognized and enjoined many oppressive laws on the books that serve no purpose except to put abortion out of reach. Unfortunately, a key tool weaponized by anti-abortion politicians — the licensure process — remains in effect, and we are unable to restore care. We stand ready to begin providing access to abortion in Missouri and will keep fighting to ensure Missourians’ rights are fully realized as soon as possible.”

“While we are pleased the court blocked most of the abortion bans and restrictions in the lawsuit, we are disappointed that today’s decision continues to allow the State of Missouri to deprive Missourians of their constitutionally protected right to abortion,” said Richard Muniz, interim President and CEO of Planned Parenthood Great Rivers. “Last month, Missourians voted to ensure abortion is available for those who need it, but this decision keeps that care out of reach, blocking patients from care and highlighting just how extreme anti-abortion politicians have been in their crusade to ban abortion. But make no mistake — this fight is not over. As litigation continues, we will do everything we can to ensure our patients have access to abortion care, no matter what.

“It is disappointing that two weeks after Amendment 3 took effect, Missourians are still unable to exercise their right to reproductive freedom,” said Planned Parenthood Federation of America president and CEO Alexis McGill Johnson. “ This is unacceptable, and we will not stop fighting to ensure that Missourians’ vote on Amendment 3 is fully realized and protected. Planned Parenthood Federation of America and our affiliated health care providers in Missouri will continue working alongside our partners to restore abortion access and protect Missourians’ reproductive freedom.”

“Today’s decision to block Missouri’s total abortion ban and several of the medically unnecessary restrictions is the first step to realizing the promise of Missourians’ new constitutional right to reproductive freedom,” said Gillian Wilcox, Director of Litigation at the ACLU of Missouri. “While the decision will not allow for plaintiffs to immediately open their doors to provide care because of restrictions that have not yet been enjoined, hospitals and health care providers across the state will be able to provide more care today than they could yesterday without the fear of criminal prosecution. We will continue to fight to see that Missourians’ constitutional rights are fully recognized by the courts.”

The case, Comprehensive Health of Planned Parenthood Great Plains and Planned Parenthood Great Rivers v. State of Missouri, was brought within 24 hours of Missouri voters passing the Right to Reproductive Freedom Initiative, which appeared as Amendment 3 on the 2024 General Election ballot. The amendment creates and protects the fundamental right to reproductive freedom, which is the right to make and carry out decisions about all matters relating to reproductive health care, including prenatal care, childbirth, postpartum care, birth control, abortion care, miscarriage care, and respectful birthing conditions.

After voter approval of Amendment 3 in November, providing access to women’s reproductive health care and abortion:

TRAP is the terminology for “targeted regulation of abortion providers”.

….Missouri has a number of statutes and regulations governing the provision of abortions and abortion care. Plaintiffs seek to enjoin Defendants from prosecuting and enforcing some of these laws. Plaintiffs allege the challenged laws in this matter penalize Plaintiffs for providing reproductive health care. It is uncontested that Plaintiffs assist patients in exercising their right to abortion and that Plaintiffs would be subject to criminal penalties for violating the challenged laws.

The Court finds Plaintiffs have standing in this matter. Plaintiffs also have third party standing to bring claims on behalf of their patients….

…Where the statutes at issue unquestionably conflict with the newly established rights afforded by Amendment 3, because they “den[y], interfer[e] with, dela[y], or otherwise restric[t]” the right to reproductive freedom, irreparable injury has been established….

….As Plaintiffs argue, they and their patients are suffering serious harm, whereas Defendants only stand to lose the ability temporarily to enforce some laws that are likely to be held unconstitutional and which further no valid compelling state interest….

….By the language of Amendment 3, the public interest is clear that voters, i.e. the public, intended to create a new fundamental right to reproductive freedom for all Missourians….

The Missouri statutes addressing a total ban on abortion, gestational age ban, and reasons ban have been enjoined by the court. The statute requiring physician admitting privileges has been enjoined. The statute requiring a medication abortion complication plan has been enjoined. The statute with pathology requirements has been enjoined. The statute requiring abortion-specific informed consent has been enjoined. The statute provisions requiring 72 hour and 24 hour waiting periods have been enjoined. The statute with the “telemedicine ban” has been enjoined.

SB 119 – This act creates the offense of possession of an abortifacient drug with the intent to induce an abortion on oneself or another person and the offense of delivery of an abortifacient drug with the intent to induce, or otherwise assist in, an abortion on another person. Missouri Attorney General Andrew Bailey (r) issued an opinion on the passage of Amendment 3 (women’s reproductive health and abortion rights) which passed on the November ballot.

…This opinion letter provides an assessment of the legal effect of Amendment 3 on five statutes. Although the Secretary of State has note yet certfied the results of the election, the unofficial results show that Amendment 3 was adopted – just barely – by a margin of 3%. In contest where the “yes” side was able in effect to rewrite the ballot summary language, received tens of millions in funding from out of state, and outspent the “no” side 6 to 1, this tight margin suggests the result may be very different if a future constitutional amendment is put up for a vote…
