“What distinguishes a concentration camp from a prison (in the modern sense) is that it functions outside of a judicial system. The prisoners are not indicted or convicted of any crime by judicial process.” – U.S. Holocaust Museum, Holocaust Encyclopedia, “Concentration Camps”
“…nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law.” – 5th Amendment, United States Constitution
“Everyone has the right to recognition everywhere as a person before the law.” – Article 6, Universal Declaration of Human Rights – December 10, 1948 (General Assembly resolution 217 A)
“Everyone shall have the right to recognition everywhere as a person before the law.” – Article 16, International Covenant on Civil and Political Rights, General Assembly resolution 220A (XXI) of 16 December 1966, entry into force 23 March 1976, entered into force for the United States on September 8, 1992
“…This Constitution, and the laws of the United States which shall be made in pursuance thereof; and all treaties made, or which shall be made, under the authority of the United States, shall be the supreme law of the land….” – Article VI, United States Constitution
Yesterday:
“…It is difficult in some cases to get to the very heart of the matter. But in this case, it is not hard at all. The government is asserting a right to stash away residents of this country in foreign prisons without the semblance of due process that is the foundation of our constitutional order. Further, it claims in essence that because it has rid itself of custody that there is nothing that can be done.
This should be shocking not only to judges, but to the intuitive sense of liberty that Americans far removed from courthouses still hold dear….
….Now the branches come too close to grinding irrevocably against one another in a conflict that promises to diminish both. This is a losing proposition all around. The Judiciary will lose much from the constant intimations of its illegitimacy, to which by dent of custom and detachment we can only sparingly reply. The Executive will lose much from a public perception of its lawlessness and all of its attendant contagions. The Executive may succeed for a time in weakening the courts, but over time history will script the tragic gap between what was and all that might have been, and law in time will sign its epitaph….
….In sum, and for the reasons foregoing, we deny the motion for the stay pending appeal and the writ of mandamus in this case. It is so ordered.” – UNITED STATES COURT OF APPEALS FOR THE FOURTH CIRCUIT, No. 25-1404 (8:25-cv-00951-PX), KILMAR ARMANDO ABREGO GARCIA v KRISTI NOEM; TODD LYONS; KENNETH GENALO; NIKITA BAKER; PAMELA JO BONDI; MARCO RUBIO (April 17, 2025)

Mark Alford

St. Garcia needs to stay in his home country.
[….]
Read the fucking court room now, Mark (r), not the mob.
Some of the responses:
That would be exactly the thing that could be brought up in front of a judge as opposed to alleged on social media (where the truth is optional). Why does my legislator object to the 5th Amendment and the Bill of Rights? It is NOT acceptable for the President to ignore the law, the Constitution, or the Supreme Court. So far the weakest link in our government has turned out to the one the Farmer’s feared would be too strong. We need a Congress with the courage to stand up to a member of their own party.
the constitution applies to everyone regardless of immigration status. There has been no proof of his relationship to any gang.
Funny this, the Fourth Circuit said just that.
I’ve read what the Supreme Court has said. They are responsible for interpreting and applying our laws. So their ruling is the one that matters, not the Attorney General’s.
What the Attorney General says about it is her argument in favor of her position. There will be a counterargument by the other side. Then the Judge will decide who is correct. But in this case, the Supreme Court has ruled. Due process for all.
all people are covered in constitution
Gaslighting much? Welcome to the new America where accusations make you guilty
The court instructed the administration to return him to the US if the plane had already taken off. The administration defied that order. The administration said they had made an error in sending him. The court said to arrange for his return. The administration has not done so. The administration took these plane loads to El Salvador, around 75% have no criminal record. I know you will say they are “illegal” and should be gone. Are you sure? I know the administration has blatantly lied about this young man and that’s what Fox viewers hear. But. Think very carefully about whether you want this to become acceptable in the US. Today it is people who are labeled “illegal” and “gang members” with no verification and no opportunity to defend or explain. They simply need and deserve DUE PROCESS. If they age indeed gang members, or have committed crimes, fine, deport to their home countries. If what we are seeing right now is ok with you, tomorrow will it be US citizens? Will it be your brother? Your sister? Neighbor? You?
Mark Alford If you’re opposed to the 5th and 14th Amendments, there’s a process to change that. If you are willing to blatantly ignore them, the rest of the Amendments are easily ignored, as well.
There is only one true and holy Amendment (April 12, 2025)
1. What crimes was he detained for? Be specific.
2. What gang was it proven he was a member of? The last Federal judge stated there was no evidence to back the claim he was in any gang.
3. Do you understand how courts work and that the higher courts overrule those of the lower courts?
4. Do you support the Constitution and understand Due Process.
I’m not the one in a ‘fantasy world’. I live in the very real world where facts and evidence matter. You are just regurgitating talking points you heard or read without actually reading up into the case.
Ultimately, I don’t care what crimes he may or may not have done. The Constitution guarantees him due process. Period. Stop. End of story.
We either support the law of the land or we do not.
I am on the side of supporting it.
Quit ignoring the fact that the immigration court said he could not be deported to El Salvador! If they wanted to deport him do it the proper way through the court and due process. If the court agreed then deport him to another country. It’s very basic but once again Trump thinks he’s above the law.
Then you need to back to Texas
Oh how very Christian of you! Did you ever read the Constitution? How about the Bill of Rights? Are you familiar with with those? The 100% fact you are ignoring this lets everyone know either 1. You are incompetent and need to resign. 2. You are a Fascist aka Nazi! Fascism is a far right, authoritarian, and ultranationalist political ideology and movement, characterized by a dictatorial leader, centralized autocracy, militarism, forcible suppression of opposition, belief in a natural social hierarchy. You hate democracy and hate the rule of law!
So if all it takes to get a man deported to that prison is DV – can we line them up now? Oh wait, just the ones who are not white? Is that the definition of Trumps “really bad” criminal status??
So you don’t support the Constitution you swore an oath to, Mark?
God hates a liar
Look everyone, Mark is lying.
