The amendment was the first of its kind and passed-by a huge margin-in August of that year. The Human Rights Campaign and other national gay rights groups had poured hundreds of thousands of dollars into the state to campaign against the amendment. Hartzler was quoted in national and international media celebrating her victory for “traditional marriage….”

WASHINGTON – Congresswoman Vicky Hartzler (R-Mo.) released the following statement in regards to today’s Supreme Court ruling in the Obergefell v. Hodges case:

“I am disappointed in the Court’s decision to stifle the voices of Missouri’s voters.  Decisions on marriage policy should be left in the hands of the 50 states, allowing those who wish to define marriage as being between one man and one woman, as we did in Missouri, to do so.  Today’s ruling tramples on the voice of the people.  I will continue to champion marriage as the union between one man and one woman so every child has the opportunity to have both a mom and a dad.”

Actually, no, the status quo was an affront to the 14th Amendment of the U.S. Constitution.

With today’s ruling, five unelected judges in Washington, D.C., stole the voice from more than a million Missourians. A statement from the president of the Recorders Association of Missouri:

Statement by the Recorders Association of Missouri Re: SCOTUS Ruling on same Sex Marriage

The primary function of the Recorder is to follow the statuatory duties for which they are entrusted as well as preserve documents with relation to property and other important events/transactions with the upmost care and consistency. One such responsibility is the issuance of marriage licenses. In recent years there have been a number of policy issues related to the function and Recorders ha[ve] consistently worked to comply with the standard at the time.

Immediately upon the ruling of the Supreme Court we requested clarification from our attorney to assess the applicability of the ruling, as well as the operational requirements such as time frame for compliance. The sum and substance of the ruling makes clear the Fourteenth Amendment to the US Constitution requires a State to license marriage between two people of the same sex. Additionally, rulings of the Supreme Court take effect 25 days after the date of the ruling unless the court states otherwise, which is not the case in this decision. It is important to point out that there is no restriction with regard to implementing the ruling before 25 days.

While we recognize the issue of same sex marriage may be uncomfortable for some in our community, the Office of recorder has consistently held itself to the highest standard of professionalism and constituent responsiveness. Our responsibilities require us to follow the law expeditiously and with care. Therefore, we are recommending to all recorders they review their current procedures related to the issuance of marriage licenses in the context of the Supreme Court’s ruling and act accordingly.

A little under an hour after this morning’s marriage equality ruling by the U.S. Supreme Court we stopped by the courthouse in Warrensburg to speak with Jan Jones, Johnson County Recorder of Deeds about the immediate impact of the ruling. Marriage licenses are issued by county recorders. As we were waiting to speak with the recorder a patron entered the office to inquire about getting a marriage license.

Patron: Yes.

Patron: I know, I understand.

Patron: Okay.

Jan Jones, Johnson County, Missouri Recorder of Deeds: And will have instructions for all Missouri recorders, uh, probably by noon today. That’s her goal.

Patron: Okay.

Jan Jones, Johnson County, Missouri Recorder of Deeds: That will tell us exactly when it’s effective, you know. We don’t think it’s immediate. Could be next business day, we think it’s going to be the twenty-five days, but we don’t know that.

We can take the application, have you all sign it, we hold it in the drawer, and then when the, the magic day happens then we can issue the license and you can leave here with the license and go to whomever’s going to marry you.

Patron: Okay.

Patron: Okay. That sounds like a plan. We’re gonna make that happen then.

I just didn’t know if anything was gonna change because I don’t.  You wouldn’t think and you wouldn’t think it would take ’em long due to the fact there’s other states that have, so.

Jan Jones, Johnson County, Missouri Recorder of Deeds: Right. We’re ready to go. We just need, you know, we have, things have changed, we just need the attorney to say this is the day that we can begin issuing. So, soon as I hear back I can give you a call, let you know what they’ve told me, and we’ll move from there.

The U.S. Supreme Court ruled [pdf] 5-4 today that marriage equality is a 14th Amendment right and that same sex marriages in one state must be recognized in all other states.

No union is more profound than marriage, for it embodies the highest ideals of love, fidelity, devotion, sacrifice, and family. In forming a marital union, two people become something greater than once they were. As some of the petitioners in these cases demonstrate, marriage embodies a love that may endure even past death. It would misunderstand these men and women to say they disrespect the idea of marriage. Their hope is not to be condemned to live in loneliness, excluded from one of civilization’s oldest institutions. They ask for equal dignity in the eyes of the law. AN ACT

To repeal section 451.022, RSMo, and to enact in lieu thereof one new section relating to marriages other than a marriage between a man and a woman, with an emergency clause.

Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A. Section 451.022, RSMo, is repealed and one new section

2 enacted in lieu thereof, to be known as section 451.022, to read as follows:

451.022. 1. It is the public policy of this state to recognize marriage only between a man and a woman.

2. Any purported marriage not between a man and a woman is invalid.

3. No recorder shall issue a marriage license, except to a man and a woman.

4. A marriage between persons of the same sex other than a marriage between a man and a woman will not be recognized or enforced for any purpose in this state even when valid where contracted.

5. (1) No state or local taxpayer funds or salaries of an employee of the state or any political subdivision or instrumentality of the state shall be disbursed for an activity that includes the licensing or support of marriage other than a marriage between a man and a woman.

(2) Any employee of the state or any political subdivision or instrumentality of the state who willfully and knowingly violates the provisions of this section may be terminated and shall no longer receive any salary and employee benefits.

(3) Any active employee who is a member of any retirement system established by the state of Missouri or any political subdivision or instrumentality of the state for the purpose of providing plan benefits for elected or appointed public officials or employees of the state of Missouri or any political subdivision or instrumentality of the state, who is not yet vested as of the effective date of this section, and who willfully and knowingly violates the provisions of this section shall not be eligible to receive any retirement benefits from the respective plan, except such member may still request from the respective retirement system a refund of the member’s plan contributions, including interest credited to the participant’s account.

Section B. Because of the need to clarify licensing procedures, section A of this act is deemed necessary for the immediate preservation of the public health, welfare, peace and safety, and is hereby declared to be an emergency act within the meaning of the constitution, and section A of this act shall be in full force and effect upon its passage and approval.

He must have inadvertently left out the death penalty. Stoning could work.

Priorities. Think of all those localities and the legal fees they’re going to pile up.

With an emergency clause? Let it go, dude.

Today, a post on Senator Claire McCaskill’s (D) non-government web site:

The question of marriage equality is a great American debate. Many people, some with strong religious faith, believe that marriage can only exist between a man and a woman. Other people, many of whom also have strong religious faith, believe that our country should not limit the commitment of marriage to some, but rather all Americans, gay and straight should be allowed to fully participate in the most basic of family values.

I have come to the conclusion that our government should not limit the right to marry based on who you love. While churches should never be required to conduct marriages outside of their religious beliefs, neither should the government tell people who they have a right to marry.

My views on this subject have changed over time, but as many of my gay and lesbian friends, colleagues and staff embrace long term committed relationships, I find myself unable to look them in the eye without honestly confronting this uncomfortable inequality. Supporting marriage equality for gay and lesbian couples is simply the right thing to do for our country, a country founded on the principals of liberty and equality.

Good people disagree with me. On the other hand, my children have a hard time understanding why this is even controversial. I think history will agree with my children.

The times they are a-changin’…
