Missouri Fraternal Order of Police Endorse Teresa Hensley for Attorney General
 
INDEPENDENCE, MO – Democratic nominee for Attorney General Teresa Hensley announced her endorsement today from the Missouri Fraternal Order of Police (FOP).  Making announcements in Cass County – where Hensley served as prosecutor for 10 years – and in Kansas City, she was joined by members of the MFOP, representing 6,500 members statewide. 
 
“Missouri’s Attorney General is the people’s attorney and I have dedicated my career to seeing that every Missourian is fairly represented under the law,” said Hensley.  As Cass County’s top prosecutor, I worked with local law enforcement to lock up dangerous criminals, including murderers, rapists, and domestic abusers. My office, in coordinating with local law enforcement, won more than ninety child sex abuse convictions, hundreds of felony convictions, and 21 murder convictions.  We helped seniors avoid scams, and we put scammers in jail.  Most of all, I worked with police to see that the law was carried out fairly and equally.”

The Missouri FOP has over 6,500 members comprised primarily of full-time rank-and-file law enforcement officers employed in Missouri.  They work daily to rid the streets of criminals and provide the best working conditions for those that employ themselves in that endeavor. 
 
Teresa Hensley has received the Missouri Attorney General’s 2010 Justice Award for Domestic Violence Prevention, and she was selected by the Missouri Association of Prosecuting Attorneys (MAPA) to serve as 2014 Chair of the Missouri DWI and Traffic Safety Best Practices Committee. She was a member of the Missouri Child Abuse and Neglect Review Board and a former board member of Hope Haven, a women’s abuse shelter.

Wagner stands up for CHOICE to deregulate banks, kill Dodd-Frank

Today in the St. Louis Post-Dispatch I read an article about the override of the Governor’s veto of SB656 (the guns unlimited “constitutional” carry gun law). In order to underline the dangerous potential of the new law, Kevin Allbrand, an official with the Fraternal Order of Police, is quoted saying “this is not some type of banking regulation, this is public safety and law enforcement safety.”

Not some kind of banking regulation? What kind of fool thinks we can ignore what happens with our money and still live safe, happy lives? Guns kill, it’s true, but what legislators do about banking regulation affects many more lives than even horrible gun laws.

Remember the 2008 Bush recession? Poor regulatory choices created a crisis that nearly plunged us into a depression rivaling that of the 1930s, a very bad time for lots of people. I bring the recession up not just because it’s a good example of the harm perpetrated by regulatory negligence and financial malfeasance, but because a gaggle of House legislators are working hard to return financial regulation to the pre-2008 status quo ante that nearly cratered our economy.

And right up front of that gaggle, you’ll find Missouri’s Ann Wagner (R-2). She gets lots of money from the financial industry and does her best to represent their interests. If you’re concerned about your financial welfare, you should pay attention to her pro-banking, anti-consumer priorities

Wagner has been a persistent player in Republican efforts to deregulate the banking industry back to its pre-2008 status. Her efforts to derail Department of Labor (DOL) fiuciary rules have been incorporated into the The Creating Hope and Opportunity for Investors, Consumers and Entrepreneurs (CHOICE) Act, a recent Republican effort to replace the Dodd-Frank Act which was enacted to protect Americans from the banking abuses typical before the Bush recession..

Wagner has persistently fought to strangle new DOL fiduciary rules that mandate that investment advisers privilege their clients interests over their own. Under the new rules, financial agents can no longer encourage clients to invest in inappropriate or sub-standard products which may kick back substantial fees to the advisor responsible for the sale. Wagner, and her generous banker clients, claim that if financial advisers can’t swindle their clients, they won’t reap enough of a profit to make advising small investors worthwhile. Only Wagner never uses the word “swindle.” See how it works?

Wagner has tried twice in the past few years to undo the new rules via direct legislation. Her Retail Investor Protection Act, H.R. 1090 – note the Bizarro World title – was aimed at incapacitating DOL rule-making ability in essentially the same way as her earlier effort, H.R. 2374. Both bills limped off to die elsewhere after passing out of the House. Apparently Wagner thinks the third time’s the charm since her zombie legislation is now back, incorporated into the CHOICE act.

The CHOICE Act, to be fair, contains many other problematic provisions apart from Wagner’s specific contributions. For example it proposes to repeal the Volcker Rule, and the Durbin amendment which limits fees for credit card transactions.

Notably, it would also cripple the GOP’s (and Wagner’s) special bête noire , the Consumer Protection Financial Bureau (CFPB) – the same agency that just fined Wells Fargo $185 million after exposing a scam wherein bank employees opened 2 million unauthorized, accounts for customers that fraudulently generated $1.5 million in fees for the bank – and earned bonuses and other incentives for the employees. Even before this coup, the CFPB had returned $11 billion to consumers who “were cheated on their mortgages, credit cards, checking accounts, and other financial products.” The CFPB is by any measure effective in pursuing its goals. Too effective for financial institutions used to running wild with our money.

It all just goes to show that when their financial industry clients howl, Wagner’s congressional clique gets to work to fix their ouchie. Voila the CHOICE Act. And if consumers bleed, so be it.

Kyle Garner, the Democratic Party nominee in the 52nd Legislative District who is challenging incumbent Nathan Beard (r), wrote the following in response to this past week’s veto session in the General Assembly:

The people of Missouri just had a very bad day. It started off with a top lobbyist for the top donor in Missouri being allowed by Republicans to speak from the dais on the Senate floor. Lobbyists getting what they wanted would be the theme of the day.

During the veto session on Wednesday, the Republicans who control our legislature went on a rampage against the people of Missouri. They made it harder to vote and easier for anyone to carry a gun anywhere, unchecked and untrained. They put industry representatives in charge of policing their own water pollution. They gave a $50 million retroactive handout to special interests without budgeting for it. They voted to fine the poorest people in the state if they use an emergency room or miss a doctor’s appointment. They spent the day celebrating their unchecked authority taunting Democrats, voters and the Governor on social media, while refusing to help any Missourians.

The voter ID bill they passed will cost the state $17 million dollars and they didn’t account for a dime of that in the budget. $17 million that we don’t have for a problem, voter impersonation, which does not exist. It’s been 10 years now that the GOP has been pushing for this law and in that time they have yet to produce even one instance of voter impersonation. The last known case of voter impersonation in the state was in the 1930s. But photo ID hurts Democratic voters more than Republican voters, and so it passed.

The irresponsible gun bill they passed takes away any training requirements and allows anyone to carry a concealed weapon anywhere. It adds “stand your ground” language to our state so if someone “feels threatened” they can shoot another person, regardless of location or actual threat. It was opposed by groups including Moms Demand Action, The Fraternal Order of Police, and The Catholic Church. It was opposed by Sheriffs. It was opposed by prosecuting attorneys. It was opposed by 86% of Missourians. It was opposed by anyone with a lick of common sense. But the NRA lobbyists who own the Republican Party demanded it and so it passed.

The amendment to the Clean Water Commission changed the requirements of the membership makeup of the Commission. Instead of a minimum of 4 members of the public and a maximum of 2 industry representatives being on the commission, the new law allows there to be 0 members of the public and no less than 2 industry reps. That means those polluting industries will be the ones making the laws for their own businesses. This change hurts the public interest, but it helps the lobbyist-backed industries who donate to the lawmakers, and so it passed.

The change to allow any farm disaster payments to be tax free opens the door to abuse and moral hazard, as it incentivizes farmers to take an insurance payment rather than incur taxes by selling their products. It also creates an immediate $50 million hole in the budget as the legislature made the change retroactive to 2014. Once again, the GOP spent $50 million without bothering to budget for it in order to give a handout to special interests. What happened to fiscal responsibility?

The worst of these bills though is the change to the Medicaid rules. The Republicans, who refuse to expand Medicaid in Missouri and bring back billions of our dollars to the state and who refuse to help 300,000 Missourians access health care, are now actively attacking the poorest Missourians and discouraging them from seeking medical care. SB 608 allows doctors and hospitals to fine Medicaid users if they show up to the emergency room and are determined to not have an emergency. It allows them to fine the poorest people in our state if they miss a doctor’s appointment.

This law is reprehensible. It’s immoral, it’s unjust, and like so many laws passed by our inept Republican supermajority, it likely runs afoul of federal law meaning if we try to enforce it we lose out on even more of our federal tax dollars.

The people of Missouri deserve better than this. We deserve better than a government that only serves the special interests that throw millions of dollars into Republican committee accounts. We deserve better than a legislature ruled by people who, by their actions, clearly loathe the least fortunate among us. We deserve better than a Party that will claim repeatedly that there is no money for roads, or schools, or healthcare, or state workers, or public defenders, but will turn around and hand out hundreds of millions of dollars in tax cuts to industries that can afford lobbyists. We deserve better than Republican politicians who will make sure everyone knows the Democrat Governor has no power in the state, but then blame him for the budget shortfalls the legislature creates. This November, we must stand up and make our voice heard that we the people of Missouri demand a better government.

Today Donald Trump (r) proceeded to crap all over his campaign again, holding a non-press conference tour of his new hotel which was shopped as his birther retraction, the presentation of which was enabled by old media. The event was a circus. As it turned out Donald Trump used the media coverage to accuse Hilary Clinton of starting the Obama birther nonsense. Most national media covering that statement correctly labeled it as a lie.

This evening the a news anchor at the Kansas City NBC affiliate reported on the story in their 5:00 p.m. broadcast, recounting Trump’s accusation about Hillary Clinton. There was no context other than “he said.”
