….In 2004, Hartzler drew national and international attention for her work in the campaign for a constitutional amendment in Missouri to ban gay marriage. The amendment was the first of its kind and passed-by a huge margin-in August of that year. The Human Rights Campaign and other national gay rights groups had poured hundreds of thousands of dollars into the state to campaign against the amendment. Hartzler was quoted in national and international media celebrating her victory for “traditional marriage….”

WASHINGTON – Congresswoman Vicky Hartzler (R-Mo.) released the following statement in regards to today’s Supreme Court ruling in the Obergefell v. Hodges case:

“I am disappointed in the Court’s decision to stifle the voices of Missouri’s voters.  Decisions on marriage policy should be left in the hands of the 50 states, allowing those who wish to define marriage as being between one man and one woman, as we did in Missouri, to do so.  Today’s ruling tramples on the voice of the people.  I will continue to champion marriage as the union between one man and one woman so every child has the opportunity to have both a mom and a dad.”

Actually, no, the status quo was an affront to the 14th Amendment of the U.S. Constitution.

With today’s ruling, five unelected judges in Washington, D.C., stole the voice from more than a million Missourians. A statement from the president of the Recorders Association of Missouri:

June 26, 2015

Statement by the Recorders Association of Missouri Re: SCOTUS Ruling on same Sex Marriage

The primary function of the Recorder is to follow the statuatory duties for which they are entrusted as well as preserve documents with relation to property and other important events/transactions with the upmost care and consistency. One such responsibility is the issuance of marriage licenses. In recent years there have been a number of policy issues related to the function and Recorders ha[ve] consistently worked to comply with the standard at the time.

Immediately upon the ruling of the Supreme Court we requested clarification from our attorney to assess the applicability of the ruling, as well as the operational requirements such as time frame for compliance. The sum and substance of the ruling makes clear the Fourteenth Amendment to the US Constitution requires a State to license marriage between two people of the same sex. Additionally, rulings of the Supreme Court take effect 25 days after the date of the ruling unless the court states otherwise, which is not the case in this decision. It is important to point out that there is no restriction with regard to implementing the ruling before 25 days.

While we recognize the issue of same sex marriage may be uncomfortable for some in our community, the Office of recorder has consistently held itself to the highest standard of professionalism and constituent responsiveness. Our responsibilities require us to follow the law expeditiously and with care. Therefore, we are recommending to all recorders they review their current procedures related to the issuance of marriage licenses in the context of the Supreme Court’s ruling and act accordingly.

A little under an hour after this morning’s marriage equality ruling by the U.S. Supreme Court we stopped by the courthouse in Warrensburg to speak with Jan Jones, Johnson County Recorder of Deeds about the immediate impact of the ruling. Marriage licenses are issued by county recorders. As we were waiting to speak with the recorder a patron entered the office to inquire about getting a marriage license.

Show Me Progress: So, uh, you, you just heard about the Supreme Court ruling?

Patron: Yes.

Show Me Progress: And so you decided to come out here?

Patron: Right.

Patron: I was just making sure she was handing me the right brochure. I didn’t know if you guys were gonna change one or what.

Jan Jones, Johnson County, Missouri Recorder of Deeds:  Well, I’m kind of glad you said something about changing it. As soon as, what we’re waiting for right now, it was just issued.

Patron: Okay. Right, right.

Patron: I know things don’t happen [finger snap].

Jan Jones, Johnson County, Missouri Recorder of Deeds:  Right.

Patron: I know, I understand.

Jan Jones, Johnson County, Missouri Recorder of Deeds:  Our, our association attorney is reviewing, um, the ruling…

Patron: Okay.

Jan Jones, Johnson County, Missouri Recorder of Deeds: And will have instructions for all Missouri recorders, uh, probably by noon today. That’s her goal.

Patron: Okay.

Jan Jones, Johnson County, Missouri Recorder of Deeds: That will tell us exactly when it’s effective, you know. We don’t think it’s immediate. Could be next business day, we think it’s going to be the twenty-five days, but we don’t know that.

We can take the application, have you all sign it, we hold it in the drawer, and then when the, the magic day happens then we can issue the license and you can leave here with the license and go to whomever’s going to marry you.

Patron: Okay.

Patron: Okay. That sounds like a plan. We’re gonna make that happen then.

I just didn’t know if anything was gonna change because I don’t.  You wouldn’t think and you wouldn’t think it would take ’em long due to the fact there’s other states that have, so.

Jan Jones, Johnson County, Missouri Recorder of Deeds: Right. We’re ready to go. We just need, you know, we have, things have changed, we just need the attorney to say this is the day that we can begin issuing. So, soon as I hear back I can give you a call, let you know what they’ve told me, and we’ll move from there.

Patron: It’s a big day.

The U.S. Supreme Court ruled [pdf] 5-4 today that marriage equality is a 14th Amendment right and that same sex marriages in one state must be recognized in all other states.

No union is more profound than marriage, for it embodies the highest ideals of love, fidelity, devotion, sacrifice, and family. In forming a marital union, two people become something greater than once they were. As some of the petitioners in these cases demonstrate, marriage embodies a love that may endure even past death. It would misunderstand these men and women to say they disrespect the idea of marriage. Their plea is that they do respect it, respect it so deeply that they seek to find its fulfillment for themselves. Their hope is not to be condemned to live in loneliness, excluded from one of civilization’s oldest institutions. They ask for equal dignity in the eyes of the law. Here’s Some Stupid for Afternoon Tea

In which Claire McCaskill calls out Bernie Sanders’ socialism and forces us to compliment Mark Halperin.

….Missouri Senator Claire McCaskill, whose appeal to liberals beyond Not Being A Republican I never will understand, was there, and they were asking her about the mini-sensation that Bernie Sanders is causing out on the hustings these days….

….What came next was a real shock. Mark Halperin asked McCaskill for three policy positions held by Sanders that she would call Socialist positions. McCaskill’s gob was utterly smacked….

….Another reason not to like Claire McCaskill: She just made the staff at the Cafe compliment Mark Halperin.

Now you’ve gone and done it. That last one is beyond the pale.

Gov. Jay Nixon today issued the following statement regarding the U.S. Supreme Court’s ruling in King v. Burwell.

“Today’s ruling is good news for hundreds of thousands of working Missourians who will continue to have access to affordable health coverage through the federal exchange,” said Gov. Nixon.  “However, it is important to note that there are hundreds of thousands more Missourians who continue to be denied access to affordable health care due to the Missouri legislature’s inaction on Medicaid.

“Today’s ruling by the Roberts Court to uphold the Affordable Care Act a second time removes all doubt that the ACA is and will remain the law of the land.  There are no more excuses for continuing to send our tax dollars to other states and denying 300,000 working Missourians the opportunity to access affordable health care coverage through Medicaid expansion.  I look forward to working with the General Assembly next session to finally bring our tax dollars home and provide affordable health coverage to hundreds of thousands of hard-working Missourians through Medicaid expansion.”

Today, in a 6-3 decision, the U.S. Supreme Court upheld health insurance subsidies in states with federal exchanges. A lot of Missourians can breathe a little easier now.

….The combination of no tax credits and an ineffective coverage requirement could well push a State’s individual insurance market intoa death spiral. It is implausible that Congress meant the Act to operate in this manner. Congress made the guaranteed issue and community rating requirements applicable in every State in the Nation, but those requirements only work when combined with the coverage requirement and tax credits. It thus stands to reason that Congress meant for those provisions to apply in every State as well….
