Over the past ten days or so we’ve covered a variety of events. A town hall on gun violence in Kansas City, Kansas which included students from Marjory Stoneman Douglas High School in Parkland Florida, and several demonstrations against Donald Trump’s (r) policy of separating immigrant children from their parents and placing them in concentration camps – in downtown Overland Park, Kansas; downtown and on the Plaza in Kansas City, Missouri; and in Columbia, Missouri. In the meantime the right wingnut controlled U.S. Supreme Court upheld the latest iteration of Donald Trump’s (r) Muslim travel ban.

On Friday evening we covered a demonstration near the entrance of the Plaza in Kansas City organized by a coalition of Muslim community groups and allies. About 150 people showed up – modest, yet still effective by Kansas City standards. There was the usual Kansas City Police presence.

About an hour into the demonstration a lone Trump supporter, by his flag, showed up. And then later still, a half dozen or so other right wingnuts showed up in matching t-shirts, bearing matching flags and signs, who strutted past the Muslim demonstration.

It’s quite simple, really, if you single out a religious minority you’re a bigot. That’s it.

His editor would cut the first line and the fourth line, then call it truth in advertising.

Uh, about that lack of civility…

Diversity fail.

They have Congress, the have the executive branch, and they have the Supreme Court. What makes them so aggrieved that they’d show up to a modest and harmless demonstration like this? That they’re so insecure that they demand absolute fealty to their supreme leader?

That’s just like Barack and Michelle Obama! Oh, wait….

Wait, is that guy wearing American flag underpants out in public? Go figure.

Why here? Why now? Why this demonstration and not the others? What was the difference?

Yesterday evening Muslim community and interfaith organizations held a KC Rally for Muslims, Immigrants, & Refugees by the J.C. Nichols Fountain at Mill Creek Park near the entrance to the Plaza in Kansas City. About 150 individuals showed up to demonstrate and to hear speakers including a poet, imams and a rabbi. All spoke of peace, love and justice.

There was a proactive Kansas City Police presence.

About an hour into the rally a group of right wingnut anti-Muslim counter-protestors showed up. Wearing t-shirts emblazoned with “no immigrants, no Muslims, no refugees.”

The individual on the right is so badass they deserve another photo posting in our blog.

It was difficult to get decent images of this group, the good guys kept blocking the direct view with their signs.

The Fourth Circuit Court of Appeals has upheld the preliminary injunction on Donald Trump’s (r) revised Muslim ban executive order:

The question for this Court, distilled to its essential form, is whether the Constitution, as the Supreme Court declared in Ex parte Milligan, 71 U.S. (4 Wall.) 2, 120 (1866), remains “a law for rulers and people, equally in war and in peace.” And if so, whether it protects Plaintiffs’ right to challenge an Executive Order that in text speaks with vague words of national security, but in context drips with religious intolerance, animus, and discrimination. Surely the Establishment Clause of the First Amendment yet stands as an untiring sentinel for the protection of one of our most cherished founding principles—that government shall not establish any religious orthodoxy, or favor or disfavor one religion over another. Congress granted the President broad power to deny entry to aliens, but that power is not absolute. It cannot go unchecked when, as here, the President wields it through an executive edict that stands to cause irreparable harm to individuals across this nation. Therefore, for the reasons that follow, we affirm in substantial part the district court’s issuance of a nationwide preliminary injunction as to Section 2(c) of the challenged Executive Order.

The Government has repeatedly asked this Court to ignore evidence, circumscribe our own review, and blindly defer to executive action, all in the name of the Constitution’s separation of powers. We decline to do so, not only because it is the particular province of the judicial branch to say what the law is, but also because we would do a disservice to our constitutional structure were we to let its mere invocation silence the call for meaningful judicial review. The deference we give the coordinate branches is surely powerful, but even it must yield in certain circumstances, lest we abdicate our own duties to uphold the Constitution.

As we previously determined, the Government’s asserted national security interest in enforcing Section 2(c) appears to be a post hoc, secondary justification for an executive action rooted in religious animus and intended to bar Muslims from this country. We remain unconvinced that Section 2(c) has more to do with national security than it does with effectuating the President’s promised Muslim ban….

…The Government has argued that, even if lawful permanent residents have due process rights, the States’ challenge to section 3(c) based on its application to lawful permanent residents is moot because several days after the Executive Order was issued, White House counsel Donald F. McGahn II issued “[a]uthoritative [g]uidance” stating that sections 3(c) and 3(e) of the Executive Order do not apply to lawful permanent residents. At this point, however, we cannot rely upon the Government’s contention that the Executive Order no longer applies to lawful permanent residents. The Government has offered no authority establishing that the White House counsel is empowered to issue an amended order superseding the Executive Order signed by the President and now challenged by the States, and that proposition seems unlikely.

Nor has the Government established that the White House counsel’s interpretation of the Executive Order is binding on all executive branch officials responsible for enforcing the Executive Order. The White House counsel is not the President, and he is not known to be in the chain of command for any of the Executive Departments. Moreover, in light of the Government’s shifting interpretations of the Executive Order, we cannot say that the current interpretation by White House counsel, even if authoritative and binding, will persist past the immediate stage of these proceedings. On this record, therefore, we cannot conclude that the Government has shown that it is “absolutely clear that the allegedly wrongful behavior could not reasonably be expected to recur…”

…The States argue that the Executive Order violates the Establishment and Equal Protection Clauses because it was intended to disfavor Muslims. In support of this argument, the States have offered evidence of numerous statements by the President about his intent to implement a “Muslim ban” as well as evidence they claim suggests that the Executive Order was intended to be that ban, including sections 5(b) and 5(e) of the Order. It is well established that evidence of purpose beyond the face of the challenged law may be considered in evaluating Establishment and Equal Protection Clause claims…

…The States’ claims raise serious allegations and present significant constitutional questions…

Yesterday, from LivingBlueinRedAmerica:

I watched Jewish, Muslim and Christian protesters side by side. Fighting for people they have never met and would never know.

I saw America.

This afternoon over a thousand people showed up at Terminal C, the international terminal, at Kansas City International Airport to protest Donald Trump’s Muslim ban.

I watched a Jewish man, wearing a head covering, stand with the crowd. I watched two women hug another woman who was wearing a hijab – she was overwhelmed by the demonstration of support she was witnessing. I watched Christian ministers in their collars move among the protesters.

I watched the Police doing their job, protecting the First Amendment. I watched an officer carefully escorting protesters in the crosswalk. I watched another officer taking photos of protestors with their phone cameras at the barrier at their request and handing their phones back with a smile.

I watched a self satisfied troll at the edge of the crowd shout, “Build that wall!”. I watched a journalist give him a look, shake her head, and reply, “whatever.”

I watched a young Muslim woman walk along the barrier and joyfully thank everyone for their signs and for being there.

I watched a few people leave and enter the terminal in grim silence. This is what Democracy looks like. They should get used to it.

I watched other travelers happily take cell phone photos and selfies with the demonstration in the background.

I listened to two hours of non-stop chanting.
