HB 960 — ORDERS OF PROTECTION
SPONSOR: McCreery

This bill requires courts that issue a full order of protection after a hearing to prohibit any respondent from possessing or purchasing firearms while the order is in effect, inform the respondent of the order either orally or in writing, and forward the order to the State Highway Patrol for enforcement as specified in the bill.

The bill also requires notification of the State Highway Patrol so that the National Instant Criminal Background Check system can be updated and the FBI notified when there is a conviction of stalking in the second degree. Unlawful possession of a firearm will include misdemeanor offenses of domestic violence under the law of any state or the United States and violations of the court order specified in the bill.

The bill has an emergency clause.

It makes complete sense. It will never again see the light of day in the right wingnut controlled Missouri General Assembly.

Representative Tracy McCreery (D) – May 17, 2018.

Representative Tracy McCreery (D) moved for the House to suspend Rule 42 so that an amendment could be offered to the Senate Revision Bill. The amendment would add the language to remove now unconstitutional references in statute contrary to marriage equality.

In the Rules of the Missouri House:

It’s the law of the land, but the majority is just being petulant.

Before you wring your hands over the wisdom of suspending the rules you might note that earlier the House voted to suspend Rule 22, allowing conference committees to meet while the House was in session and later suspended Rule 99, which allowed members and staff to wear tennis shoes on the floor of the House.

Representative McCreery offered an amendment, a member of the majority raised a point of order, the Speaker ruled against offering the amendment since Rule 42 was not suspended.

The Senate Revision bill(s):

SCS/SRBs 975 & 1024 – This act repeals specified expired, ineffective and obsolete statutory provisions…

The House then voted on the Senate Revision bill(s), without any corrections based on marriage equality.

JEFFERSON CITY – The man chosen by Missouri Secretary of State Jay Ashcroft to lead the agency that protects consumers from securities fraud is a former executive of a company currently under investigation by the state.
David Minnick served as general counsel and senior vice president of St. Louis-based Stifel Financial Corp. from 2004 until this week, when Jay Ashcroft took over for outgoing Secretary of State Jason Kander.
Now, Minnick is the commissioner of securities, a job that puts him in charge of the division responsible for protecting Missouri investors from fraud and ensuring that companies comply with state securities law.

409.6-601. (a) This act shall be administered by the commissioner of securities who shall be appointed by and act under the direction of the secretary of state, and shall receive compensation as provided by law. After December 31, 2017, the secretary of state shall not appoint as the commissioner of securities anyone who was employed, within one year of the appointment, by an entity that was under investigation by a state or federal governmental unit within one year of the appointment, if the existence of the investigation of the entity was made known to the general public. Section A. Section 130.034, RSMo, is repealed and one new section enacted in lieu 2 thereof, to be known as section 130.034, to read as follows:

3. Notwithstanding the provisions of this section or any other section, a candidate committee shall not:
(1) Expend or transfer funds from the committee, for any purpose, to any person related, within the fourth degree of consanguinity or affinity, to the candidate who formed the candidate committee; or
(2) Expend or transfer funds from the committee, for any purpose, to any entity wholly or partially owned by a person related, within the fourth degree of consanguinity or affinity, to the candidate who formed the candidate committee.

Guns. More on guns, actually. Well, also, the ability to use your gun anywhere when you’re afraid. Anywhere. Without retreating. To “stand your ground”. Anywhere. Does anyone really think this is a good idea in a civil society? The republicans in the Missouri General Assembly certainly do.

563.031. 1. A person may, subject to the provisions of subsection 2 of this section, use physical force upon another person when and to the extent he or she reasonably believes such force to be necessary to defend himself or herself or a third person from what he or she reasonably believes to be the use or imminent use of unlawful force by such other person….
….2. A person shall not use deadly force upon another person under the circumstances specified in subsection 1 of this section unless:
(1) He or she reasonably believes that such deadly force is necessary to protect himself, or herself or her unborn child, or another against death, serious physical injury, or any forcible felony….

(3) If the person is in any other location such person has the right to be.
[….]
5. The defendant shall have the burden of injecting the issue of justification under this section. If a defendant asserts that his or her use of force is described under subdivision (2) of subsection 2 of this section, the burden shall then be on the state to prove beyond a reasonable doubt that the defendant did not reasonably believe that the use of such force was necessary to defend against what he or she reasonably believed was the use or imminent use of unlawful force.

Quite a few Democratic members of the House spoke out against the bill and its open season provision.

Representative Hoskins (r) spoke in support of the bill because he was concerned that his children’s grandparents otherwise wouldn’t be able to defend his family in his home in his stead if he were away and an intruder threatened them.

You’d think that a significant percentage of county prosecutors have been going after people who have used a weapon to defend another family member’s home against armed (or not) intruders.

Representative Burlison (r) closed with “…[we] wouldn’t want people to pay fees to exercise their right to vote…”. This in defense of a gun bill after this same republican controlled General Assembly pushed for voter photo ID.

The bill was truly agreed to and finally passed.

Later the House brought up SCR 50 which designates the month of September as Suicide Prevention Awareness Month.

Representative Tracy McCreery (D) was recognized to speak about the resolution. After she started speaking the Speaker admonished her to not address the previous bill. Representative McCreery continued, noting that guns are used quite a lot in suicides and also noting the hypocrisy of a body which had just passed a bill making it easier for people to use guns.

McCreery's victory: a good development in a tough political landscape

Tracy McCreery won her November primary and the general election in one fell swoop. She took it handily, for a three way race, with almost 44 percent of the vote. I had my doubts that a progressive, no matter how much admired by her supporters, should risk giving that seat to a Tea Party Republican. But, judging by the passionate support she mustered, we’re going to be tickled pink to have her in the lege.

Last month, she was part of a list that Arthur Lieber ticked off when he spoke to the West County Democrats. Lieber, whose most recent claim to fame was challenging Todd Akin last year, favors a positive take on life whenever he can. So he provided a list of some promising developments. He was encouraged that Obama has drawn a line in the sand about vetoing any revenue bill that doesn’t include more taxes on the wealthy; about the sort of, well, stunning evidence that Elizabeth Warren isn’t selling out for campaign cash; and–to return to the topic at hand–about McCreery’s run for the seat in the 83rd.

So anyway, 44 percent of the vote for McCreery, huh? If I could catch a crow, I’d eat it.

By the way, that blog Lieber refers to, where both he and his wife, Gloria Bilchik, contribute, is Occasional Planet.  Bilchik is also a positive thinker. And Lieber has a quirky idea to lure Obama away from Goldman Sachs contributions and make him indebted instead to progressives. If somebody with a national mailing list would step up, this idea could fly.

Total Votes   3,748

At least Patrick Brennan (r) got to add still another proof to the General Theory of Crazification.

The St. Louis County republican web site reacts predictably.

Abortion activist, Tracy McCreery, wins Missouri 83rd District election.

While Missouri needs a government to support all of our businesses, identity politics will be the order of the day in the 83rd.

“…Missouri needs a government to support all of our businesses…” That world view would probably explain some of the result for the republican candidate.

St. Louis GOP is a publication from the St. Louis County Central Committee. This group is made up of elected committeemen and committeewoman from each township in St. Louis County. Their goal is to identify Republicans for office and help get them elected.
