(c) Representation to the Court. By presenting and maintaining a claim, defense, request, demand, objection, contention, or argument in a pleading, motion, or other paper filed with or submitted to the court, an attorney or party is certifying that to the best of the person’s knowledge, information, and belief, formed after an inquiry reasonable under the circumstances, that:
(1) The claim, defense, request, demand, objection, contention, or argument is not presented or maintained for any improper purpose, such as to harass or to cause unnecessary delay or needless increase in the cost of litigation;
(2) The claims, defenses, and other legal contentions therein are warranted by existing law or by a nonfrivolous argument for the extension, modification, or reversal of existing law or the establishment of new law;
(3) The allegations and other factual contentions have evidentiary support or, if specifically so identified, are likely to have evidentiary support after a reasonable opportunity for further investigation or discovery. An attorney providing drafting assistance may rely on the otherwise self-represented person’s representation of facts, unless the attorney knows that such representations are false; and
(4) The denials of factual contentions are warranted on the evidence or, if specifically so identified, are reasonably based on a lack of information or belief.

On Wednesday evening The Committee for County Progress in Jackson County hosted a public debate [a forum, really] between Teresa Hensley and Jake Zimmerman, the two Democratic candidates for Attorney General in Missouri, at the University of Missouri-Kansas City School of Law courtroom. Mary Sanchez of the Kansas City Star was the moderator.

The two Democratic Party candidates made opening and closing statements, answered questions from the moderator, and answered questions submitted by the audience in the forum which lasted about an hour and a half. The discussions ranged from the administrative demands of the office of Attorney General, the role of the office, the death penalty, consumer fraud, assistance for local law enforcement and county prosecutors, the assault on Planned Parenthood (including the bogus and debunked charges of selling fetal tissue), and on. At several points the issue under discussion included addressing the radical views of the two republican candidates for the office.

Teresa Hensley (D): ….Both [Josh] Hawley and Senator Kurt Schaefer are actually my favorite topics lately. [laughter] And you know, Josh Hawley actually said he would give an Attorney General’s opinion, as if the Attorney General’s opinion was his personal opinion that someone wouldn’t have to follow the law, uh, and that they could follow their religious beliefs as he set out and as Kim Davis set out.

Uh, Senator Kurt Schaefer is showing his colors as well. Let’s talk about Planned Parenthood and his, uh, attack on them. When you look at a man who has a law degree, he claims he’s practiced law, and yet he knows, as an attorney and as the Attorney General, uh, under Supreme Court Rule 55[.]03 he would be prevented from issuing that subpoena to Planned Parenthood, uh, because he has no reasonable basis. Not only was the [grounds for the] investigation, uh, found to not exist, the very people who initiated that fraud have been charged with a crime. And so here we have a man, who is a senator, who claims to want to be the top law enforcement officer of the State of Missouri, knows that what he’s issuing is a subpoena is just basically with no basis, uh, there’s no theory for what he’s doing. He’s showing us what he would do as Attorney General. He would be someone that we would have to be concerned about in his politics, his politicizing, uh, he’s wholly political. This is a law office first. It’s an office of over a hundred and eighty attorneys which enforces the law. And so, to have someone like Josh Hawley or Senator Kurt Schaefer in that position ought to be frightening to all of us.

Jake Zimmerman: ….Let’s talk about the kind of behavior Senator Schaefer has engaged in here, because it maybe even goes a little bit worse than you might think. Uh, as part and parcel of the politicization of this issue, trying to score some points in a Republican primary, you know what he did? He threatened the budget of the University of Missouri as retribution if they did not deny privileges to a doctor practicing at the Planned Parenthood clinic in Columbia. So I want you to think about that. He wanted to hurt higher education in this state, including the very citizens that he himself represents, to score some political points and to make sure that women in mid-Missouri didn’t have access to health care. And you know what? He succeeded. The university caved to his pressure under very real fear of what the Senate appropriations chair would do to their budget….

There’s a minimum critical mass in campaign fundraising when any candidate runs for statewide office in a down ballot race (uh, anything statewide that’s not Governor or U.S. Senate). The amount of money is usually somewhere in the six digit range when it comes close to the primary date. Seven digits is nice, but where is the candidate gonna spend it all before the primary? We are certain that the campaign consultant industrial complex will find a way.

This morning we attended the largest annual single gathering of politicians in Missouri, outside of the General Assembly, at the Governor’s Ham Breakfast on the grounds of the Missouri State Fair in Sedalia. It makes for an interesting juxtaposition – potential political opponents for statewide and legislative office milling around and greeting each other, breakfast attendees, and the media.

Kansas City, MO – Today Democrat Teresa Hensley announced that she is starting her campaign to become Missouri’s next Attorney General.

“As a former prosecutor, I saw the pain and the devastation families experience when they’re the victims of violent crime. I saw parents who lost children to drunk drivers, and children who lost their innocence to abuse. But I also saw the power of justice in action. I saw people begin to put their lives back together after justice was served in a court of law,” said Hensley “That’s why I’m running. I have a unique understanding of the power and importance of the Office of the Attorney General. As the state’s top prosecutor, I will seek justice with honesty and integrity for Missouri’s families.”

Shortly after her announcement, Missouri State Senator Scott Sifton and former candidate for Attorney General offered his endorsement, “Teresa Hensley has the prosecutor experience we need in our next Attorney General. Her experience as a prosecutor far exceeds that of the other candidates in the field.”

Hensley stated she looked forward to continuing and expanding the Attorney General Office’s strong tradition of defending victims’ rights and protecting consumers against fraud. She was recognized for that work as Cass County Prosecutor and plans to continue it at the state level. Hensley will also prioritize protection of senior citizens from financial scams, and work with community leaders to create safer, more secure communities for Missouri families.

About Teresa Hensley

Teresa Hensley has devoted her career to fighting for justice, the rights of victims, and protecting those most vulnerable in our communities. These qualities and experience make her ideally suited to become Missouri’s next Attorney General.

Hensley is a life-long Missourian. She began kindergarten at Raymore Elementary and remained at Raymore-Peculiar High School until graduating in 1977. She earned a Bachelor of Arts degree from William Jewell College and her Juris Doctorate from the University of Missouri Kansas City Law School.

Hensley was appointed to the position of Cass County Prosecutor in January of 2005; she was elected to the position in November of 2006 and again in 2010 for a four-year term that began January 2011. Hensley received the 2010 Missouri Attorney General’s Justice Award for Domestic Violence Prevention. She participated as prosecutor in the Child Abuse Response Team, the Fire Investigation Team, and the DWI Task Force. In 2014, she was selected by the Missouri Association of Prosecuting Attorneys (MAPA) to serve as Chair of the Missouri DWI and Traffic Safety Best Practices Committee.

Hensley remains active in the day-to-day life of the community. She served as a Raymore Alderman, Raymore Planning and Zoning Board member, and as a member of the Missouri Child Abuse and Neglect Review Board, as well as a board member of Hope Haven. She is currently a member of the Bel-Ray Sunrise Lions Club, the Harrisonville Rotary Club, the Harrisonville Business and Professional Women, and Beta Sigma Phi of Lake Winnebago.

Hensley is a family law mediator. She taught social studies at Leavenworth Public Schools in the Alternative Program and criminal law at William Jewell College. Before becoming Cass County Prosecutor in 2005, she was a partner and practicing attorney for fourteen years with the Hensley Law Firm in Raymore with her husband, Kenny.

She grew up in Raymore, Missouri, where her parents and family still reside. She opened a law office with her husband Kenny Hensley in 1991 in Raymore and was there until she became Prosecutor in 2005. Kenny and Teresa were married in 1979 and have one son, Frank, who lives in Los Angeles with his wife Heather.

Founded: 1983

Ideology: Anti-Gay

The Family Research Council (FRC) bills itself as “the leading voice for the family in our nation’s halls of power,” but its real specialty is defaming gays and lesbians. The FRC often makes false claims about the LGBT community based on discredited research and junk science. The intention is to denigrate LGBT people in its battles against same-sex marriage, hate crimes laws, anti-bullying programs and the repeal of the military’s “Don’t Ask, Don’t Tell” policy.

To make the case that the LGBT community is a threat to American society, the FRC employs a number of “policy experts” whose “research” has allowed the FRC to be extremely active politically in shaping public debate. Its research fellows and leaders often testify before Congress and appear in the mainstream media. It also works at the grassroots level, conducting outreach to pastors in an effort to “transform the culture….”

“This is another case of ‘gotcha politics’ against a conservative leader. Todd Akin has a long and distinguished record of defending women, children and families. He has fought against forcing taxpayers to subsidize abortion giant Planned Parenthood, which is the bedrock of Claire McCaskill’s base of support. When speaking about the issue of rape, let’s not forget the cover-up of statutory rape by Planned Parenthood, which to my knowledge has not been addressed by Senator McCaskill.

“Throughout his twelve years in Congress, Todd Akin has supported legislation that honors all human life. He has opposed the commodification of women in contrast to his opponent, Claire McCaskill, who has a long record of promoting the abortion industry while ignoring how abortion harms women. We know Todd Akin, and FRC Action PAC enthusiastically endorses his candidacy,” Mackey concluded.
