It wasn’t even close. By over nineteen points.

There was a special election in the 17th Senate District today to fill the vacancy due to Ryan Silvey’s (R) gubernatorial appointment to the Missouri Public Service Commission. The candidates were Representative Lauren Arthur (D) and Representative Kevin Corlew (R).

The republican Missouri Senate Campaign Committee spent a significant amount of money running a contant deluge of nasty fear/immigrant televison ads in the Kansas City media market. Those ads obviously didn’t work in the manner they were intended.

Lauren Arthur (D) [2018 file photo].

The results from the Clay County Board of Election Commisioners:

Clay County – 17th Senate District Special Election – 100% reporting
Corlew – 9,917 40.28%
Arthur – 14,674 59.61%
Write In – 27 0.11%

From Senator Claire McCaskill (D), via Twitter:

Claire McCaskill @clairecmc
Congratulations Senator Arthur! It’s a flip…red to blue. Thanks to all the hard work of Lauren and many volunteers we have won a state senate seat that Trump won and was held by a Republican. By a lot!! Not even close….

Well, yes. In the 2016 General Election:

The republican Missouri Senate Campaign Committee is paying for a run of fear/immigrant attack ads in the Kansas City media market with formulaic sinister voiceovers, dreary music, and dark images of the Democratic Party candidate in the 17th Senate District, Lauren Arthur. The republican candidate, and the beneficiary of the ads, is Kevin Corlew. The special election will take place on Tuesday, June 5th.

Who is helping pay for all that? Yesterday at the Missouri Ethics Commission:

17th Senate District, Kevin Corlew, Lauren Arthur, missouri, special election

There is a special election in the 17th Senate District on June 5th to fill the vacancy due to Ryan Silvey’s (R) gubernatorial appointment to the Missouri Public Service Commission. The candidates are Representative Lauren Arthur (D) and Representative Kevin Corlew (R).

Representative Lauren Arthur (D) [2018 file photo].

An excerpt fom Representative Arthur’s Missouri House of Representatives bio:

…Rep. Arthur returned home to Kansas City to join Teach for America. She worked as a middle school teacher. She taught English Language Arts at Urban Community Leadership Academy, a charter school in the urban core. During that time, Rep. Arthur earned her Masters in Education from University of Missouri – St. Louis…

An excerpt from Representative Corlew’s Missouri House of Representatives bio:

…In addition to his legislative duties, Representative Corlew is an attorney. His practice involves business litigation at a law firm in Kansas City…

Since we live in the Kansas City media market we’ve been seeing a lot of television ads for this race in rotation. Apparently someone thinks Representative Arthur is an evil person. Since she was a teacher that does seem to fit into the standard narrative of the right wingnut republican universe.

Today the Kansas City Star endorsed Lauren Arthur (D) in the June 5th special election:

…Arthur is the clear choice. She has a detailed, almost encyclopedic grasp of policy. And her stands on an array of issues align with positions this editorial board has taken, including opposition to tax cuts that favor corporations over workers, support for the Clean Missouri ethics reforms, full rights for LGBT citizens, allowing Kansas City and other cities to boost their minimum wage and common-sense gun legislation…

While also praising Kevin Corlew (faintly, and somewhat desperately, we might add) as a “moderating influence” on the republican super majority in the House the editorial can only come up with his support for increasing the state’s gas tax as a means for addressing transportation infrastructure needs as one of his significant public policy virtues. Think about that for a second. A regressive tax.

There’s a lot of money flowing into this race.

Welcome to Missouri and America in the era of Donald Trump.

We’ll see what happens next Tuesday.

General Assembly, HB 1633, Kevin Corlew, missouri, Wanda Brown

There are three days left in the regular legislative session. Time is running out. Bills are going back and forth between the Senate and the House. If there are differences then one house needs to accept what the other has done, or they can refuse and go to a conference committee. Time is of the essence for pending legislation.

Yesterday, just before noon, the House proceeded to consider sending SS SCS HB 1633 (on criminal offenses) to a conference with the Senate. The bill was handled on the House floor by Representative Kevin Corlew (R):

Rep. Kevin Corlew (R) – on the floor of the House – May 15, 2018.

Representative Wanda Brown (R) took the opportunity to inquire about a number of items in the bill. This took time.

An inqury.

Rep. Wanda Brown (R) – on the floor of the House – May 15, 2018.

As always (there have been a few exceptions), the discussion on the House floor followed prescribed rules of decorum. However, the tension and frustration of both participants was evident.

Eventually the House approved the request for a conference with the Senate by a voice vote.

House Communications @MOHOUSECOMM
By a voice vote, #MOHouse refuses to adopt HB 1633 (Lesser Included Offenses) and requests the Senate recede from its position & failing to do so grant the House a conference thereon.

TSA begins notifying travelers of 2018 REAL ID Act requirements for security checkpoints
Wednesday, December 14, 2016 by HPN News Desk

The Transportation Security Administration (TSA) recently began posting notices at airports to inform travelers that the agency will begin enforcing REAL ID requirements at airport security checkpoints beginning in Jan. 2018.
The REAL ID program stipulates that any traveler suing their state-issued driver’s license or identification card for boarding commercial aircraft may only use such documents if they are issued by a REAL ID-compliant state or a non-compliant state with an extension.
The notification follows a recent announcement issued by U.S. Department of Homeland Security Secretary Jeh Johnson regarding the final phase of the REAL ID Act. While REAL ID-compliant documents will become the standard for commercial air travel, passengers may continue to use other forms of identification such as a passport, military ID or permanent resident card.
“At present, 23 states are fully compliant with the REAL ID Act, and the department has used its authority to grant states extensions when they demonstrate steps toward compliance,” Johnson said in his original announcement. “Thus, 27 states and territories have been granted extensions for a period of time to become compliant. Six states and territories – Illinois, Minnesota, Missouri, New Mexico, Washington, and American Samoa – are noncompliant and do not currently have extensions.”
[….]

[emphasis added]

Missouri ID is noncompliant.

During the George W. Bush (r) administration:

Passed by Congress in 2005, the REAL ID Act enacted the 9/11 Commission’s recommendation that the Federal Government “set standards for the issuance of sources of identification, such as driver’s licenses.” The Act established minimum security standards for state-issued driver’s licenses and identification cards and prohibits Federal agencies from accepting for official purposes licenses and identification cards from states that do not meet these standards…..

From the Missouri General Assembly in 2009:

[TRULY AGREED TO AND FINALLY PASSED]
HOUSE COMMITTEE SUBSTITUTE FOR
HOUSE BILL NO. 361
95TH GENERAL ASSEMBLY

0637L.03T                                                            2009

AN ACT

To repeal section 302.171, RSMo, and to enact in lieu thereof two new sections relating to noncompliance with the federal REAL ID Act of 2005.

Be it enacted by the General Assembly of the state of Missouri, as follows:

[….]

302.183. 1. Notwithstanding any provision of this chapter that requires an applicant to provide reasonable proof of residence for issuance or renewal of a noncommercial driver’s license, noncommercial instruction permit, or a nondriver’s license, an applicant shall not have his or her privacy rights violated in order to obtain or renew a Missouri noncommercial driver’s license, noncommercial instruction permit, or a nondriver’s license.
            2. Any data derived from a person’s application shall not be sold for commercial purposes to any other organization or any other state without the express permission of the applicant without a court order; except such information may be shared with a law enforcement agency, judge, prosecuting attorney, or officer of the court, or with another state for the limited purposes set out in section 302.600 or for conducting driver history checks in compliance with the Motor Carrier Safety Improvement Act, 49 U.S.C. 31309. The state of Missouri shall protect the privacy of its citizens when handling any written, digital, or electronic data, and shall not participate in any standardized identification system using driver’s and nondriver’s license records.
            3. The department of revenue shall not amend procedures for applying for a driver’s license or identification card in order to comply with the goals or standards of the federal REAL ID Act of 2005, any rules or regulations promulgated under the authority granted in such act, or any requirements adopted by the American Association of Motor Vehicle Administrators for furtherance of the act.
            4. Who voted for and enabled this paranoid mess?

And that’s why, children, Missourians can’t enter a federal courthouse, military facility or nuclear power plant using their Missouri Driver’s License as identification. And, come January 2018, Missourians won’t be able to fly on a commercial aircraft unless they have another form of identification, like their U.S. Passport.

So, who gets to clean up this paranoid mess? Your right wingnut republican controlled Missouri General Assembly.

A bill, filed in the House last week:

HB 151
Requires the Department of Revenue to issue REAL ID compliant driver’s licenses unless the applicant requests a license that is not compliant with the REAL ID
Sponsor: Corlew, Kevin (014)
Proposed Effective Date: Emergency Clause
LR Number: 0401H.01I
Last Action: 12/06/2016 – Prefiled (H)
Bill String: HB 151
Next Hearing: Hearing not scheduled
Calendar: Bill currently not on a House calendar

Gee, there’s an emergency clause. Don’t think that retroactively fixes your Missouri Driver’s License. If the bill passes, you’ll get compliant ID when you renew. Unless you want to pay to renew earlier.

The summary [pdf] for HB 151:

HB 151 — REAL ID COMPLIANT LICENSES
SPONSOR: Corlew
This bill requires the Department of Revenue to amends its procedures for applying for a driver’s license or identification card in order to comply with the federal REAL ID Act. The department is currently prevented from complying with the act. This bill requires that the department give applicants the option of either a compliant license or a license that is not in compliance with the federal REAL ID Act. The department will be required to inform applicants of the differences between the compliant and non-compliant forms of license, specifically that the REAL ID compliant driver’s license can be used for federal purposes such as domestic air travel and gaining access to military bases and most federal government facilities while the non-compliant license cannot. The bill specifies that any biometric data collected for these purposes will be retained only for the purposes of complying with the REAL ID Act. This bill is similar to HCS HB 2235 (2016).

Another bill, filed in the House last week:

HB 166
Requires the department of revenue to issue REAL ID compliant driver’s licenses unless the applicant requests a license that is not compliant with the REAL ID
Sponsor: Davis, Charlie (162)
Proposed Effective Date: Emergency Clause
LR Number: 0184H.02I
Last Action: 12/07/2016 – Prefiled (H)
Bill String: HB 166
Next Hearing: Hearing not scheduled
Calendar: Bill currently not on a House calendar

There’s that emergency clause.

The summary [pdf] for HB 166:

HB 166 — REAL ID COMPLIANT LICENSES
SPONSOR: Davis
This bill requires the Department of Revenue to amend its procedures for applying for a driver’s license or identification card in order to comply with the federal REAL ID Act. The department is currently prevented from complying with the act. This bill requires that the department give applicants the option of either a compliant license or a license that is not in compliance with the federal REAL ID Act. Good luck getting that through the General Assembly. Meanwhile, if you want to count on flying after January 2018 you might want to get your U.S. Passport.

FIRST REGULAR SESSION
HOUSE BILL NO. 155 [pdf]
99TH GENERAL ASSEMBLY

INTRODUCED BY REPRESENTATIVE CORLEW.

AN ACT

To repeal section 144.054, RSMo, and to enact in lieu thereof twenty-five new sections relating to the Interstate 70 Public-Private Partnership Act, with a penalty provision.
[….]
(11) “Project”, the interstate highway corridor incorporated into the state highway system, administered by the commission, and designated by the commission as Interstate 70. The project shall be located from where Interstate 70 intersects with Interstate 470 in the county with a charter form of government and with more than six hundred thousand but fewer than seven hundred thousand inhabitants to where Interstate 70 intersects with Interstate 64/U.S. Route 40 within the county with a charter form of government and with more than three hundred thousand but fewer than four hundred fifty thousand inhabitants that is to be financed, developed, or operated under agreement between the commission and a private partner…
[….]
227.760. 1. The commission and private partner may use any method to impose, collect, and enforce user fees for the use of the project, which may include, but are not limited to, toll tickets, barrier toll facilities, subscription fee accounts, billing accounts, commuter passes, electronic recording or identification devices, or other such technological advances as may be consistent with the form or function of collection of revenue for the use of the project. The display of a recording or identification device issued or authorized by the private partner to collect and enforce user fees for the use of the project on or near the windshield of a motor vehicle shall not be a violation of any law or rule in the state unless the device is attached in a manner that obstructs the operator’s clear view of the project.
2. The private partner operating the project shall post notice on and around the project in the plain view of motor vehicle operators using the project that reads as follows: “NOTICE: FAILURE TO PAY REQUIRED USER FEES IS A TRAFFIC VIOLATION. ANY FAILURE TO PAY THE REQUIRED USER FEES SHALL BE REPORTED TO THE APPROPRIATE LAW ENFORCEMENT OFFICIALS, WHO WILL ISSUE A TRAFFIC CITATION.”

[….]

[emphasis in original]

If passed the bill will start the process to turn Interstate 70 into a toll road.
