There are three days left in the regular legislative session. Time is running out. Bills are going back and forth between the Senate and the House. If there are differences then one house needs to accept what the other has done, or they can refuse and go to a conference committee. Time is of the essence for pending legislation.

Yesterday, just before noon, the House proceeded to consider sending SS SCS HB 1633 (on criminal offenses) to a conference with the Senate. The bill was handled on the House floor by Representative Kevin Corlew (R):

Representative Wanda Brown (R) took the opportunity to inquire about a number of items in the bill. This took time.

As always (there have been a few exceptions), the discussion on the House floor followed prescribed rules of decorum. However, the tension and frustration of both participants was evident.

Eventually the House approved the request for a conference with the Senate by a voice vote.

AN ACT

To amend chapter 252, RSMo, by adding thereto one new section relating to reimbursement for automobile damage inflicted by deer.

Be it enacted by the General Assembly of the state of Missouri, as follows:

Section A. Chapter 252, RSMo, is amended by adding thereto one new section, to be known as section 252.270, to read as follows:

252.270. The department of conservation shall reimburse any automobile owner in an amount up to five hundred dollars for damages sustained to the automobile due to hitting or being hit by a deer. The department of conservation shall establish rules and regulations to implement the provisions of this section. Any rule or portion of a rule, as that term is defined in section 536.010, that is created under the authority delegated in this section shall become effective only if it complies with and is subject to all of the provisions of chapter 536 and, if applicable, section 536.028. This section and chapter 536 are nonseverable, and if any of the powers vested with the general assembly under chapter 536 to review, to delay the effective date, or to disapprove and annul a rule are subsequently held unconstitutional, then the grant of rulemaking authority and any rule proposed or adopted after August 28, 2015, shall be invalid and void.

What the gun culture has done for Missouri

 If guns are the answer and not the problem, as the NRA set claims, Missouri ought to be a very safe state with low rates of gun violence. A quick and dirty review of current Missouri legislation shows a very gun-friendly environment:

— Guns can be carried openly except in a few specified locations (e.g., churches, airports, polling places, etc.) where they are prohibited.

— Individuals 21 and older are permitted to carry concealed handguns in the glove compartment of their cars.

— Local jurisdictions are forbidden to enact gun laws that are stricter than those enacted by the state.

— Missouri has a “castle law” that permits individuals to shoot first and think later if they believe themselves to be threatened within the confines of their home or their car.

— No categories of guns (e.g., assault weapons) are prohibited, there is no waiting period to purchase a gun, nor do guns need to be registered.

Since the state is already so permissive in regard to gun ownership, many state GOP politicians have had to go the extra mile into crazyland in order to show their contempt for those of us who believe in the rule of law rather than force and would like to see some regulation of deadly weapons. In 2013 alone lawmakers have proposed the following:

— GOP Mike Leara (Dist. 96) introduced legislation that would imprison fellow legislators for attempting to introduce gun safety legislation.

— GOP Rep. Casey Guernsey (Dist. 2) put forward a bill that would make it illegal for any elected official to carry out provisions of federal gun safety legislation, killing two birds with one stone – gun safety and promoting the spurious tenther nullification drivel promoted by sour grapes GOPers who want to be able to nullify democracy by evading laws they don’t like.

— GOP Rep. Wanda Brown (Dist. 116) has offered SB 639 which would prohibit doctors and other health care professionals from asking patients (even those suffering from gun-shot wounds) about firearm ownership or keeping such information in medical records. It also prohibits school employees from asking students about guns in their homes.

So what has all this guns are good, regulation bad, furor done for Missouri? Take a look at the map below that shows the states with the most gun violence:

Makes you think, doesn’t it? Looks like the states that have a no-holds barred approach to gun ownership have much higher rates of gun violence than other states. That includes Missouri which, you will note, ranks in the top ten states for gun violence. No wonder the NRA has to resort to the tin-foil hat, black-helicopter stuff to rally the faithful and keep the gun industry mollified. When the truth doesn’t work for you, the bigger the lie, the better.

Addendum:  What is it about the GOP that they think its a good thing to squelch information and keep folks in the dark? You will notice that the chart above is based on information from the Centers for Disease Control – presumably information similar to the statistics Rep. Brown seeks to suppress with SB639 described above.

Interviewer: According to state law I can’t let that influence my decision to hire you.

Interviewee: So I get the job?

Interviewer: Hell no. But it’s not about the guns. I think you’re gay, and that’s something the state says we CAN discriminate against.

Can employers still “morally object” to paying for coverage of self-inflicted gunshot wounds and/or accidental discharges?

This will make the next Accounting vs. I.T. touch football game more interesting.

To amend chapter 571, RSMo, by adding thereto one new section relating to discrimination against persons for the lawful carry or use of firearms.

Be it enacted by the General Assembly of the state of Missouri, as follows:

           Section A. Chapter 571, RSMo, is amended by adding thereto one new section, to be known as section 571.123, to read as follows:

           571.123. 1. It shall be an unlawful employment practice under section 213.055 for an employer, because an individual has a concealed carry endorsement or uses his or her firearm for lawful purposes including, but not limited to, self defense:

           (1) To fail or refuse to hire or to discharge any individual, or otherwise to discriminate against any individual with respect to such individual’s compensation, terms, conditions, or privileges of employment; or

           (2) To limit, segregate, or classify his or her employees or his or her applicants in any way which would deprive or tend to deprive any individual of employment opportunities or otherwise adversely affect his or her status as an employee.

           2. This section shall not be interpreted to require employers to allow the carrying and use of weapons on their property except as mandated by other general law.

           3. Nothing in this section shall be interpreted to require an employer to grant preferential treatment to employees that hold concealed carry endorsements or own firearms.

If the bill becomes law:

Is health insurance part of the compensation or privilege of employment? Not to republicans the way they’ve been carrying on.

Besides, Senator Roy Blunt (r) didn’t get his way.
