SB 147 was introduced by Senator David Sater (r). The bill summary:

MOTORCYCLE HEADGEAR (Sections 302.020 and 302.026)

…This act also provides that qualified operators who are 18 or older may operate a motorcycle or motortricycle without a helmet if he or she is covered by a health insurance policy or other form of insurance which will provide the person with medical benefits for injuries incurred as a result of a motorcycle or motortricycle accident. Proof of such coverage shall be provided on request of law enforcement by showing a copy of the qualified operator’s insurance card…

Motorcyle helmet law

The House and Senate signed off on a package of transportation-related changes in state law, including one that would lift the requirement that all riders wear protective headwear.

Motorcycle riders under the age of 18 would still need to wear a helmet. Those over 18 could go without if they have health insurance.

During earlier debate, lawmakers agreed motorcyclists should wear helmets, but some said the choice should be a matter of personal freedom.

“I think there’s a limit of what government should be involved in our lives,” Sen. David Sater, R-Cassville said.

“…some said the choice should be a matter of personal freedom.” Like, maybe, personal medical decisions? Just asking.

He’s no where close to connecting the dots here, is he?

It’s the same individual and the same wedge issue, just in different chambers of the General Assembly.

Now consider this:

Republican Who Blamed Pregnant Rape Victims for Not Taking Plan B Tried to Restrict Plan B Access

….The latest entrant is Missouri state legislator David Sater, who is sponsoring a bill that would extend the waiting period for an abortion from 24 hours to 72 hours. Naturally, there’s no rape exception, and naturally, Sater’s got some strong words about the irresponsibility of rape victims to justify not including one. “If a woman decides not to go to the hospital and not get the ‘Plan B,’ they’re making a decision to keep that child if they get pregnant,” he said. “If the woman found out she was pregnant three or four weeks down the line, they had made the decision not to do some preventative things like Plan B….”

….Sater may believe that women need to be swift in their Plan B procurement, but he also apparently thinks that it should be very difficult for women to procure Plan B. In 2010, Sater sponsored a bill that would allow pharmacies not to stock emergency contraception if they don’t want to and prevent women-presumably including rape victims-from suing pharmacies for not doing so. So, rape victims: You’re expected to get it together so quickly post-rape that you don’t forget to take emergency contraception, even though you’re not allowed to expect any pharmacies to actually stock the stuff….

Think about that. Senator David Sater (r) believes that the waiting period for an abortion should be extended from 24 to 72 hours. And he also believes that there should be no exception for rape victims because it’s up to them to immediately access and use “Plan B”. He also believes that “Plan B” access should be limited. That’s not consistency, that’s not logic, that’s our right wingnut republican controlled General Assembly in action.

Is anyone really surprised?

Oh, by the way, Senator Sater (r) is a pharmacist:

….Senator Sater is a native of Barry County where he owned and operated Sater Pharmacy for almost thirty years. He is a 1972 graduate of the University Missouri – Kansas City School of Pharmacy….

AN ACT

To amend chapter 576, RSMo, by adding thereto one new section relating to the offense of unlawful search, with a penalty provision.

Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A. Chapter 576, RSMo, is amended by adding thereto one new section, to be known as section 576.175, to read as follows:

576.175. 1. For the purposes of this section, the term “government officer” shall mean a person who is:

(1) An officer, employee, or agent of the federal or state government, or any political subdivision thereof;

(2) Acting under a contract with the federal or state government, or a political subdivision thereof, to provide security or law enforcement services; or

(3) Acting under color of federal, state, or local law.

2. A person commits the offense of unlawful search if such person is a government officer and, as part of a determination of whether to grant another person access to a publicly accessible venue or form of transportation, such person intentionally and without probable cause:

(1) Touches the anus, breast, buttocks, or sexual organ of the other person, including touching through clothing;

(2) Removes a child younger than eighteen years of age from the physical custody or control of a parent, guardian of the child, or a person standing in the stead of a parent or guardian of the child;

(3) Otherwise engages in conduct constituting an offense under subdivision (5) of subsection 1 of section 565.070; or

(4) Harasses, delays, coerces, threatens, intimidates, or effectively denies or conditions access to the venue or form of transportation because of the person’s refusal to consent to any of the actions described in this subsection.

3. The offense of unlawful search is a class A misdemeanor.

“…or effectively denies or conditions access to the venue or form of transportation because of the person’s refusal to consent to any of the actions described in this subsection…”

If you won’t go through a scanner and if you won’t consent to a search the TSA isn’t going to let you on the plane. Uh, generally, air travel falls under interstate commerce. And that’s when the supremacy clause kicks in:

In the United States Constitution, Article VI:

….This Constitution, and the laws of the United States which shall be made in pursuance thereof; and all treaties made, or which shall be made, under the authority of the United States, shall be the supreme law of the land; and the judges in every state shall be bound thereby, anything in the Constitution or laws of any State to the contrary notwithstanding….

HB1778 (Organ Donor Awareness Day) passed 141-7 with 7 Republicans (Cynthia Davis, Ed Emery, Doug Ervin, Tim Flook, David Sater, Rodney Schad, Bryan Stevenson) voting Nay.

There’s diminishing returns and all in the reaction for these things. But apparently that was the time to make a stand against the tyranny of the government making people aware of organ donation.
