SS/SCS/SB 8 – This act ensures that co-employees shall be released from liability for all workplace injuries under the workers’ compensation system except when they engage in an affirmative negligent act that purposefully and dangerously caused or increased the risk of injury.
“Toxic exposure” is defined as any prolonged chemical exposure that can cause death, abnormalities, disease, mutations, cancer, deformities, or reproductive malfunctions in a human organism if consumed by a human or when otherwise entering the human body in sufficient quantities to do so. Claims for injury and death due to such exposure shall not be compensable under the workers’ compensation system but instead, allowed to proceed as negligence claims in tort.
